To Whom It May Concern:

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

- A list of all interventions (commonly known as "raids") by the Multi-Agency Response to Community Hot Spots (also known as M.A.R.C.H.), including the date and time of each intervention, the reason(s) for intervening, the name and location of business(es) targeted, the violation(s) identified, the type of license(s) revoked, the type and amount of fine(s) levied, and the participating agencies for each intervention (Police Department, Fire Department, Department of Health, Department of Buildings, etc.). This list should include all interventions since the inception of M.A.R.C.H. in the 1990s. This list should be provided in a machine-readable format.

- Any documents detailing M.A.R.C.H.'s organizational structure and procedural policies, including policies for why, when, how, and where M.A.R.C.H. intervenes, as well as official strategies for increasing the effectiveness of interventions.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Brian Abelson

Dear Mr. Mantellino,

Thank you for your response. I had a few follow-up questions and I was hoping you or one of your colleagues could answer. If it's more convenient you could follow-up by phone. My number is 626-487-4511.

- On page one of the attached PDF it says that one of the criteria for inclusion in a M.A.R.C.H operation are "community complaints". Could you explain more what that means? Are there public records of these complaints like there are for 311 calls?

- On page two of the attached PDF it says that "community complaints and 311 calls reporting excessive noise and other quality of life violations inside or in the immediate vicinity of a location that have a nexus to an establishment may be used to support designating an establishment for inclusion in a M.A.R.C.H. Operation". Is there a precise definition for "the immediate vicinity" or "a nexus" to an establishment? For example, would an incident half a block from an establishment justify inclusion in a M.A.R.C.H operation? A whole block? A half-mile? etc.

- In the attached spreadsheet, there is a column "access_1" which seems to describe the outcome of the operation. Is there a glossary that explains these values? In particular, I'm curious what "VACATE" means? Also, are there other potential values, i.e. "access_2", "access_3", etc? Finally, why do some values start with "MARCH:" and others don't?

Thanks in advance for your help!

Best,

Brian Abelson

Hi,

I am following up on my initial request. I would like updated version of the MARCH 3 spreadsheet that was initially sent as well as answers to my initial questions:

- On page one of the attached PDF it says that one of the criteria for inclusion in a M.A.R.C.H operation are "community complaints". Could you explain more what that means? Are there public records of these complaints like there are for 311 calls?

- On page two of the attached PDF it says that "community complaints and 311 calls reporting excessive noise and other quality of life violations inside or in the immediate vicinity of a location that have a nexus to an establishment may be used to support designating an establishment for inclusion in a M.A.R.C.H.
