Mr. Ba,

I'm writing in response to your Freedom of Information Request, copied below, for a record of City of New York employees who were paid on January 4-8, 2021, including the fields Name, Salary, Position (Title), Date of Birth, Appointment Date (City Start Date), Department Start Date (Agency Start Date), and End Date. You subsequently asked for two additional fields - Race and Gender.

Enclosed is a list of City of New York employees as of the period January 4-8, 2021, including the fields Name, Title Code and Description, Salary and Pay Basis, Agency Start Date and City Start Date. The list generated is a "snapshot" report which by its nature does not include "end date".

Section 87(2)(b) of the New York State Public Officers Law provides that an agency may deny access to records which, if disclosed, would constitute an unwarranted invasion of personal privacy under the provisions of Section 89(2)(b) of the Public Officers Law. As a City of New York employee's race, ethnicity, gender and age is not relevant to the performance of a public employee's duties, the disclosure of such information for City of New York employees would constitute an unwarranted invasion of personal privacy

Further, Section 89(2)(b)(v) of the Public Officers Law defines "unwarranted invasion of personal privacy" to include "disclosure of information of a personal nature reported in confidence to an agency and not relevant to the ordinary work of such agency." Candidates for City of New York employment are invited to voluntarily supply race, ethnicity, gender and age information on condition of an express promise of confidentiality, and such information is utilized only with respect to federal reporting and other legal mandates, rather than in connection with the ordinary work of DCAS. The disclosure of individual employee race, ethnicity and gender information would therefore constitute an unwarranted invasion of personal privacy pursuant to Section 89(2)(b)(v).

For the foregoing reasons, so much of your request which seeks for race, ethnicity, gender and age data for individual City of New York employees is denied.

You may appeal the partial denial of your request by writing within 30 days to J. Carolina Chavez, General Counsel, New York City Department of Citywide Administrative Services, by email to foilrequest@dcas.nyc.gov<mailto:foilrequest@dcas.nyc.gov> , with the words "FOIL Appeal" in the subject line. Your appeal must include copies of your written request and this correspondence, and must state the particular ground or grounds upon which you are basing your appeal.
