Pursuant to Open Public Records Act ("OPRA"), I hereby request the following records:

All electronic records, dated between January 1 2013 and the date this request is fulfilled, stored in former Newark mayor Cory Booker’s office calendar that pertain to any individual’s birthday and/or date of birth). Records requested include electronic calendar entries maintained by Cory Booker’s office that indicate the date of an individual’s birthday or date of birth.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Hello,

I am writing this letter to appeal the City Clerk’s determination for Open Public Records Application # MED-12-0032.

The City Clerk states in its determination that no records that matched the following description were found:

“All electronic records, dated between January 1 2013 and the date this request is fulfilled, stored in former Newark mayor Cory Booker’s office calendar that pertain to any individual’s birthday and/or date of birth). Records requested include electronic calendar entries maintained by Cory Booker’s office that indicate the date of an individual’s birthday or date of birth.”

I am appealing the City Clerk’s determination because a previous, and unrelated, Open Public Records Application (# MED-12-0028) produced several records that match the description above. You can view the request and the responsive records at the website below:

Specifically that Open Public Records Application produced records from former Mayor Cory Booker’s office calendar that listed the birthday of a an individual named Bianca Levin. It is not clear why the City Clerk would find a record indicating her birthday while fulfilling # MED-12-0028, but not # MED-12-0032.

I ask that you conduct your search again, in the same manner you found the entry pertaining to Bianca Levin’s birthday.
