Thank you for writing to Village of Niles with your request for information pursuant to the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq.

On 5/16, you requested the following documents:

This request is made under the provisions of Illinois Freedom of Information Act. for the following records:

The recent annual drone usage report covering the period up to April 1, 2024, as required by Section 35 of the Illinois Freedom from Drone Surveillance Act (725 ILCS 167/).

Information required by statute in the annual report includes the following:

1. The total number of drones owned by the agency.

2. Details on the frequency of drone usage by the agency, including:

(a) Dates and times of operations.

(b) Purposes for drone deployment.

(c) Locations where drones were operated.

(d) Information on whether videos were recorded during these operations and whether they are retained for training or other purposes.

3. Copies of the latest policies related to drone usage by the agency as included in the annual report.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the case of any applicable fees, it is requested that an estimate of the total charges be provided prior to fulfilling this request. The preferred method of receipt is through electronic delivery.

Under the Freedom of Information Act, a public body may extend the time to respond to a FOIA request by up to 5 business days for a limited number of reasons. 5 ILCS 140/3(e). We are extending the time to respond to your request by 5 business days for the following reason(s):

We store the requested records in whole or in part at another location(s)

We have enclo0sed copies of our Policy and the 2023 Drone Report from the State of Illinois that confirms the number of drones by our agency. However it does not contain the remainder of the requested information, which was submitted electronically to the state by our drone officer. He is following up with the state to see if he came get a copy of this submission.

The public body asserts the following facts in support of the above reasons for an extension of time. The Village will respond to your request by 6/3/24
