Pursuant to the North Dakota Open Records Law, I hereby request the following records:
The following materials regarding the imposition, assessment, collection and balances of inmate fees and debt:
a) All current policies and procedures regarding medical and room & board costs or fees for which inmates are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).
b) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of individuals charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good morning,
We have received your request and estimate this will take us three hours to complete. According to ยง NDCC 44-04-18(2) an entity may impose a $25 per hour fee for locating records and excising confidential or exempt materials, minus the first hour, which is free. So your total for this request would be 3 hours x $25/hr = $75 - $25 (first hour free) = $50. Please let me know if you would still like to move forward with this request as we do require payment before releasing the records. If you do want to send a check, please let me know when the check has been mailed so I can look for it. Also note, if you want everything printed, the cost will be higher, as we do not plan to print any documents.

Good afternoon,
Attached is the work release policy. This policy does not mention room and board, but it states anyone that has been approved work release shall comply with the following rules, one of them being signing the Community Participation Rules and Regulations form (attached) which does lay out the room and board costs.
In addition, here are the accounting reports for the room and board and medical co-pays.
