Pursuant to the Ohio Open Records Law, I hereby request the following records:

A list of developments that have exited the state's LIHTC program through the qualified contract process since 2010, sufficient to show:

1) The name, full address, and ownership of all such developments
2) The total number of low-income units in all such developments
3) The year in which the decontrol period of all such developments ended (or year the qualified contract was requested, if this is not available)

I am a journalist with In These Times magazine, a nonprofit outlet based at 2040 N Milwaukee Ave in Chicago, IL.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Burns : I am responding to your request for "A list of developments that have exited the state's LIHTC program through the qualified contract process since 2010, sufficient to show: 1) The name, full address, and ownership of all such developments 2) The total number of low-income units in all such developments; 3) The year in which the decontrol period of all such developments ended (or year the qualified contract was requested, if this is not available)" After further research, OHFA has adopted the policy since 2005 to require projects to waive the qualified contract option. However, there may have been applications from projects placed in service prior to 2005.

I hope to be able to provide that information in the very near future.

You placed a public records request for-

OHFA has had a policy since 2005 that requires developers to waive the qualified contract option. Unfortunately, our records are unclear on any developers requesting a qualified contract prior to 2018 when our current head of Asset Management joined the agency. Since 2018 however there have only been five qualified contract requests. Three of these requests were approved, one was withdrawn pending approval, and one was denied outright. Of the three approved requests, one project, Willow Lake Apartments (OHFA Tracking # 96-0145), remains in the LIHTC program. The two projects that exited the LIHTC program are West Bay Apartments ( OHFA Tracking # 96-0141) and North River Homes I (OHFA Tracking # 97-0082). West Bay Apartments had its extended use period terminated thought the QC process as memorialized in the attached RC Amendment. The other project, North River Homes I, had its RC conditionally released in 2015, though ultimately this release was separate from the QC process; this is also attached.

Finally, I have attached a chart which includes the information you requested and hopefully makes the situation clearer. The only highlighted project on this chart is West Bay Apartments, as it is the only project to have its extended release period terminated directly due to the QC process.
