You are receiving this correspondence as a request under the Public Records Law, Nebraska Statutes §84-712 et seq. I am requesting the following:
All publicly-releasable records relating to the 1990 arrest of Paul A. Bonacci (DOB: August 3, 1967). Requested records include but are not limited to incident reports and criminal complaints. That year, Mr. Bonacci was arrested and convicted on three counts of sexual assault on a child. There is no expectation of a violation of Mr. Bonacci’s privacy as he has participated in interviews and made public statements over the past 30 years referencing this arrest and his alleged involvement in other similar cases. I have attached a printout from the Nebraska Department of Correctional Services verifying the terms of Mr. Bonacci's confinement and a press clipping where he attests to involvement in the abduction of a separate child in 1982. Mr. Bonacci has also made statements as recently as 2009, when he spoke with writer Nick Bryant for a book titled The Franklin Scandal. The credibility (or lack thereof) of Mr. Bonacci's account of his personal history is a matter of public interest as it generates continued focus on Douglas County's investigation into the Franklin Community Federal Credit Union and Omaha, Nebraska more generally.
I am a member of the news media, and I am asking you waive any fees associated with this request. I have previously written for PhillyVoice and Atlas Obscura. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling this request within 4 working days of receipt, as per 84-712 (4). I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
This request is not being made for commercial purposes. All documents will be provided to the general public without charge.
I look forward to your response within 4 working days. If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Your request is made pursuant to the provisions of the Nebraska Public Records Act. In your request dated October 3, 2021 requested the a copy of a reports involving the 1990 arrest of Paul A. Bonacci, DOB 8/3/67. This is the response required by NEB. REV. STAT. § 84-712(4). The reports involving Paul Bonacci's arrest involve juvenile victims, therefore, these reports do not fall under the reports we can release under NEB. REV. STAT. § 84-712(4). As such, your request is denied. Section 84-712.03 of the Nebraska Revised Statutes may grant you the right to administrative or judicial review of this response. Please consult the statute for further information. Chief of Police Todd Schmaderer is the public employee responsible for the decision to deny a portion of your request.
