Dear MuckRock News Staff;

Due to resource constraints and competing priorities associated with DCBS's response to

the COVID-19 pandemic, DCBS anticipates it will take longer than normal to process

many public records requests for the foreseeable future. This will be the case for any requests

that cannot be completed by teleworking employees, or that would require attention by

employees that are currently diverted to help mitigate the current emergency. DCBS will

strive to meet the statutory deadlines for either completing our response or to providing you

with an estimated completion date within 15 business days of your request. However,

depending upon the nature of your request, for the reasons describe above, it may be

impracticable for DCBS to comply with those deadlines. In such cases, we will nevertheless

complete our response as soon as practicable and without unreasonable delay upon the

availability of staff to do so, and their return to work in our offices, in compliance with

ORS 192.329(6) and (8).

Dear MuckRock News Staff,

I have been asked to respond to your request for records.

You had requested copies of the case files for the 18 consumer complaints regarding UnitedHealthcare Insurance Company that were confirmed in 2018 by the Division of Financial Regulation.

Please be aware that ORS 731.264 and OAR 836-005-0405(2) limit the complaint information that the director may release. OAR 836-005-0405 states:
(2) For each complaint subject to disclosure, the director shall provide:
(a) The complaint intake form;
(b) Any narrative description submitted by the complainant with the initial complaint;
(c) Any request for information submitted by the director to an insurer on behalf of the complainant in order to resolve the complaint; and
(d) Any closing letter provided to the complainant by the director, which summarizes:
(A) The complaint;
(B) Steps the director took to investigate and resolve the complaint; and
(C) Any findings and conclusions reached by the director.
(3) Before providing records to a requestor, the director:
(a) Shall remove any information that could be used to identify any individual;
(b) Shall remove any information for which disclosure is prohibited under applicable federal or state law;
(c) May remove any information exempt from public records requests under ORS 192.410 to 192.505; and
(d) May require the requestor to pay any fees listed in OAR 440-005-0025 and 440-005-0030, unless waived under ORS192.440.
Our review of the 18 confirmed UnitedHealthCare Cases for 2018 resulted in 47 pdf files. I have redacted the personal data and then combined the files into a single 84 page document.

I have been authorized to waive payment for the release these documents.
