Pursuant to the Florida Sunshine Law, I hereby request the following records:
1) User manuals, handbooks, or comparable instructional documents provided to the department by Fusus regarding the following Fusus products and services:
- FususONE
- FususCORE
- FususREGISTRY
- Fusus AI Video Analytics
- Fusus Intelligent AI Alerts
2) Audit logs/audit trails documenting each time a department account has accessed live or recorded video footage through the Fusus platforms from 1/1/2024 until the date this request is processed. To assist with your search, I've attached an example of such an audit log from another department that uses Fusus. This data should be stored in a database and so I ask that you provide it to me as a .csv, .xls, or other database filetype.
3) Metadata for each Intelligent AI Alert generated by the department's Fusus system from 1/1/2024 until the date this request is processed. Fusus Intelligent AI Alerts automatically notify authorized users when Fusus AI-connected cameras detect pre-defined events (e.g. a fight) or profiles (e.g. a vehicle of interest). Please note that I am not requesting the video footage or any personally identifying information associated with the alert, but rather the metadata. Metadata may include, but is not limited to: the type of alert, the date and time of the alert, who received the alert, locations associated with the alert, and algorithmic confidence scores associated with the alert. This metadata should be stored in a database and so I ask that you provide it to me as a .csv, .xls, or other database filetype.

I am requesting these records as a journalist in order to write articles in the public interest about the operations of a government agency and not for any commercial purpose
In the event that you determine certain records or portions of records are exempt from disclosure, I ask that you provide a detailed explanation of the records or portions of records being withheld and the statutory exemptions under which they are being withheld.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for contacting the City of Orlando. We have received your request, however, we receive hundreds of requests each week. We will process your request in the order it was received. Once we begin to process your request we will notify you if the request will take more than 30 minutes.
Pursuant to City Policy, if producing the requested records will require more than 30 minutes of total staff time, we will provide an estimate of the labor costs to retrieve the records before we begin the work. City policy also requires that we collect a deposit before work begins on records requests when an estimate is $100 or more.
Please note that no fees are due now and we will notify you if we estimate it will require more than 30 minutes to retrieve the documents you requested.

We apologize for the delay, as this request required extensive research. This is a cost estimate to pull, review, and redact the responsive logs for the time period of 1/1/2024 through 9/20/2024 (20 minutes per day to pull the log multiplied by 264 days).
While the logs don't go back to January, they will contain material that will require redaction, so this estimate will cover both the time it takes the system to retrieve the records and the time it takes to subsequently review and redact them.
We have determined that producing the records you requested will require more than 30 minutes of total staff time. Pursuant to City policy, a labor fee is imposed for such requests.
Your estimate is: $2,655.84
88 hours at $30.18 per hour for an estimated cost of $2,655.84
Please respond to this message if you agree to pay the costs involved to proceed with this request and generate an invoice. If we do not hear from you within two days, we will consider this request closed.
If the actual cost is more than the estimated amount, you will be required to pay the difference. If providing responsive records requires less than the estimated cost, we will refund any difference. If your estimate is less than $100, we will begin production of your request upon receipt of your agreement to pay the costs involved. If the estimated cost above is $100 or more, City policy requires that we collect the estimated costs before work begins on producing the requested records.

I've submitted identical records requests to other police departments who have been able to easily download logs going back to January 1, 2024 that haven't required any redactions. I'd be happy to share those with you and discuss how to fulfill this request without the amount of work you've described.

We have received the following message from the department:
Fusus audit log functionality was not designed to pull months of data for all users in the entire department simultaneously. In calculating the estimate that was provided, staff members were able to determine that it took the computer system approximately 20 minutes to pull the audit logs for all users in the department for just a single day.
Staff are obligated to review all records for any content which may be exempt or confidential and exempt from disclosure under Florida law prior to releasing such records. In reviewing a sample audit log for a single user, staff have concluded that the audit logs contain fields which may contain specific entries that are exempt pursuant to section 119.071(4)(c), Fla. Stat. (e.g., the names of undercover personnel) or which are confidential and exempt pursuant to section 119.071(3)(a), Fla. Stat. (e.g., “names” of particular cameras which may reveal the capabilities/vulnerabilities of current security or firesafety systems).
While staff have previously reached out to the vendor to inquire into whether the vendor might have a different way of pulling the requested data that would be faster than the method currently available to the department, staff have not yet received a response to that inquiry from the vendor. The estimate that has been provided reflects the time that the department believes it will take to pull the requested data using the methods currently available (approximately 20 minutes for each day being retrieved). If an alternative method becomes available, staff can potentially generate a different estimate using that method.
Please let us know if you would like to proceed with the current estimate or if you would like to wait until we have heard back from the vendor, at which time a different estimate may be generated.
