We have now heard from the appropriate department(s) with regard to your public records request.
Please note that pursuant to Florida Statute 119.07(4)(d), "[i]f the nature or volume of public records requested to be inspected or copied pursuant to this subsection is such as to require extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved, or both, the agency may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable and shall be based on the cost incurred for such extensive use of information technology resources or the labor cost of the personnel providing the service that is actually incurred by the agency or attributable to the agency for the clerical and supervisory assistance required, or both." In addition, we are required to determine whether requested records exist, locate the records, review each record to determine if it is exempt from production, and make applicable redactions as necessary.
In light of the above, we performed a preliminary search of the organization's emails between October 1, 2019 through May 31, 2020, using the search term "Brian Carroll," and located approximately 2,142 emails.
We estimate it will take our office approximately 5 hours to further complete the request to the cases you specified (2019CF010756, 2015CF001002, 2015CF000833, 2015CF000504, 2015CF002134, 2015CF000834) and to redact any information that may be confidential or exempt information from public records.
Therefore, attached is a cost estimate concerning your request with the first 30 minutes at no charge. As mentioned in our previous communications, when we ran a search for emails for just the name "James Eisenberg," it populated over 4,000 emails and many were not relating to James Eisenberg or any of the cases listed above.
However, for your convenience and to expedite this request, we ran an email search in a few different formats and used certain keywords to achieve the best representation of all the emails responsive to your request. Also, for your convenience, and since we do not know what email address Mr. Eisenberg used back in 2014-2016, we searched emails using James Eisenberg's current email address listed on the Florida Bar bigjimlaw@aol.com<mailto:bigjimlaw@aol.com>, and the current email on his website Jim@eisenbergandfounts.com<mailto:Jim@eisenbergandfounts.com>.
Four of the emails relating to jim@eisenbergandfouts.com<mailto:jim@eisenbergandfouts.com> contain dependency information and are confidential and exempt pursuant to section 119,071, Florida Statute and Fla.R.Civ.P. 2.420. It will require an additional hour and half to review and redact the attachments and emails. Please let us know if you would like to go forward with these emails, so we can send you a follow up invoice.
Finally, our last keyword search was for all emails mentioning "James Eisenberg." Once those emails populated, we narrowed the results further to each case number. From that search, we narrowed the request to only one email.
