"On February 29, 2024, the City of Park Ridge received your Freedom of Information Act request for copies of certain City records (“Your Request”), including, “all agency emails (including any attachments) that contain a Flock Safety email address <*@flocksafety.com> sent or received, including CC & BCC fields, between 12/1/2023 and the date this request is processed (inclusive of those dates),” (the “Specified Records”).

Based on the City’s preliminary search, there are 7,004 emails responsive to Your Request.

Pertinent portions of Section 3(g) of the Freedom of Information Act, 5 ILCS 140/3(g), are set out below:

Requests calling for all records falling within a category shall be complied with unless compliance with the request would be unduly burdensome for the complying public body and there is no way to narrow the request and the burden on the public body outweighs the public interest in the information. Before invoking this exemption, the public body shall extend to the person making the request an opportunity to confer with it in an attempt to reduce the request to manageable proportions. If any public body responds to a categorical request by stating that compliance would unduly burden its operation and the conditions described above are met, it shall do so in writing, specifying the reasons why it would be unduly burdensome and the extent to which compliance will so burden the operations of the public body. Such a response shall be treated as a denial of the request for information.

Based on Your Request yielding 7,004 emails requiring review, Your Request would unduly burden the City by causing it to suspend the duly-undertaken work of the City to redact and produce the Specified Records. We estimate it would take 5 business days to review and redact the records. Furthermore, since Your Request presents no description of any matter of public interest, we find that the burden to the City outweighs the public interest in the information. Consequently, the City is designating Your Request as unduly burdensome and offering you an opportunity to reduce the request to manageable proportions.

Some ways by which Your Request can be narrowed to manageable proportions include narrowing to a specific email category. The preliminary search can be divided into the following categories of communications:

1. Requests from other organizations to access Park Ridge PD camera footage (automated message)
2. Notification of other organizations sharing Hot List with Park Ridge (automated message)
3. Hot List Alerts (automated message)
4. Communication with Flock representatives
5. Webinars / product updates (automated message)
6. Upcoming maintenance (automated message)

In addition to limiting the categories of e-mail, you may also limit the scope of your request by designating specific City personnel who sent or received e-mail from Flock. If you wish to narrow Your Request to manageable proportions, please contact the undersigned to submit a substitute request.

The FOIA Officer of the City is the official responsible for this response to Your Request.

You have the right to file a review of this denial with the Public Access Counselor at: 500 S. 2nd Street, Springfield, Illinois 62706 or 217-558-0486. You also have the right to judicial review under Section 11 of the Act. If you file a request for review with the Public Access Counselor, you must also file a Notice of Appeal with the FOIA Officer.
