Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

A copy of the police log for the past week (7 days).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

RE: Access to Public Records Request – Dispatch Logs (April 30, 2014 to May 7, 2014)

Dear Mr. Musgrave:

This office is in receipt of your Access to Public Records Act (“APRA”) request received by the City on this date requesting “a copy of the police log for the past week (7 days)”. As you may know, under the APRA, a reasonable charge may be made for the search or retrieval of documents. Hourly costs for a search and retrieval shall not exceed fifteen dollars ($15.00) per hour and no costs shall be charged for the first hour of a search or retrieval. In addition, the cost per copied page of written documents provided to the public shall not exceed fifteen cents ($.15) per page. I have been informed by the Pawtucket Police Department that your request would result in a total of 381 pages and that it would take approximately 13 hours to print, review, redact and then scan the redacted logs at a total cost of $237.15.00 ($180.00 + $57.15.00). As a result, the City would require a check in that amount in advance of compiling the records.

As per R.I. Gen. Laws §38-2-8, if you believe that the City has not been responsive to your request, you may contact to or you may appeal to Mayor Donald R. Grebien, 137 Roosevelt Avenue, Pawtucket, RI 02860. You may also file a complaint with the Department of Attorney General, 150 South Main Street, Providence, RI 02903, or the Providence County Superior Court. Thank you for your response. A number of departments were able to provide digital copies of their dispatch log at no cost. Is this an option, rather than having it reviewed, redacted and mailed in hard copy?

The Pawtucket Police Department has informed that they cannot provide a digital version of the dispatch log with personally identifiable information redacted. The redactions have to b performed manually and then the redacted records can be scanned and sent to you electronically. I cannot speak to what other Departments were able to provide to you.

Dear Mr. Musgrave:

This office is in receipt of your Access to Public Records Act (“APRA”)
request received by the City on May 7, 2014 requesting the above-referenced
police log. In response to your request, the Pawtucket Police Department
has provided me with the log, which I have attached for your review. There
are 381 pages in total, so the scanned records will be sent over the course
of several emails. In addition, please be advised that after balancing the
public and private interests as the APRA requires us to do regarding the
specific information contained in any public record, this office has
redacted certain personally identifiable information contained in the log
such as dates of birth, home/mailing addresses, and social security numbers
of other persons named in the report (see Advisory Opinion 08-01, *In Re:
Police Department Policies)*.
