Pursuant to the Wisconsin Open Records Act, I hereby request the following records:

All e-mails sent by and received by Emil Norby, a.k.a. Mo Norby, between August 1, 2023, and February 1, 2024, from any county e-mail addresses that Norby had use of or access to in his official capacity as an employee of Polk County. Additionally, all text messages were sent and received from Norby's county-owned cell phone during this period.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good morning Mr. Brannon,

This correspondence is in response to your January 9th, 2023 submission to our website’s open records request form, in which you requested from Polk County the opportunity to review “all e-mails sent by and received by Emil Norby, a.k.a. Mo Norby, between August 1, 2023, and February 1, 2024, from any county e-mail addresses that Norby had use of or access to in his official capacity as an employee of Polk County.” You made an additional request in the same submission for “all text messages were sent and received from Norby's county-owned cell phone during this period.”

I’m writing back to you just to confirm the intent behind your request and make sure I’m on the same page as you. As I understand it, your request is for “any and all emails and text messages in the custody of Polk County that were sent and received by Email Norby, from August 1, 2023 to February 1, 2024.” Our public records law in the State Statutes provides us with the policy we follow for providing persons with information regarding the affairs of government and the official acts of those officers and employees who represent them. Wisconsin State Statute 19.35(1)(h) specifies that the request must have a “reasonable limitation as to subject matter” and “length of time represented by the record”. If I am understanding your request correctly, then I believe it is unreasonable as to subject matter.

If you could provide me with some more information about the records that you’re looking for, I would be happy to work with you to establish a reasonable limitation as to subject matter. What I’m looking for to begin processing your request is what the emails you are looking for are regarding, such as “any and all emails and text messages in the Custody of Polk County that were sent and received by Emil Norby, from August 1, 2023 to February 1, 2024, regarding the Government Center renovations.”
