Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

1. the total number of use of force incidents reported from 2017-2022, separated by year.

2. the total number of use of force incidents, separated by type of force and year, from 2017-2022 (for example, information that specifies the number of taser incidents in 2022, baton incidents in 2022, taser incidents in 2021, baton incidents in 2021, etc.)

3. the total number of civilian complaints against law enforcement that were reported and the total number sustained from 2017-2022, separated by year.

4. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2017-2022, separated by year.

5. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2017-2022, separated by year.

6. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2017-2022, separated by year.

7. the total number of officer-involved shootings from 2017-2022, both fatal and non-fatal, separated by year.

8. the total number of people who police used force against in 2022, broken down by race/ethnicity.

When available, I would appreciate being sent individualized data in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The City of Reading received your RTK request.

We apologize for the delay, but we require additional time to respond to your request. As such, per Section 902 of the Right-to-Know Law, the City is exercising its right to an extension of up to 30-days to respond to your request due to and the current situation with staffing limitations and/or the need for a legal review of the requested records prior to a final response the City customarily exercises this right to ensure we do not miss the initial deadline. I anticipate that you will receive a response to your request in 2-5 weeks depending on the amount of review necessary. If the records produced pursuant to your request are less than 40 pages, the fee will be waived.

Good afternoon,

Please read below for the response available from the Reading Police Department:

- Total Number of Civilian complaints alleging any form of law enforcement misconduct and the total number sustained in 2021 – Thirteen Civilian Complaints of Officer Misconduct. Four Of those complaints were sustained.

- Total Number of civilian complaints alleging law enforcement use of excessive force and total number sustained in 2021 – Four Allegations of excessive force. Two of those allegations were sustained.

- Total Number of civilian complaints alleging biased policing or racial profiling and the number sustained in 2021 – One allegation that an Office used racist language. This complaint was not sustained as far as the officer using racist language. It was found that her was “rude” to the complainant.

- Total Number of civilian complaints alleging criminal conduct and number sustained in 2021 – Two allegations that Officers engaged in criminal conduct (both complaints alleged the officers engaged in this conduct while off duty). One of these complaints was sustained.

- Total Number of Civilian complaints alleging any form of law enforcement misconduct and the total number sustained in 2022 – Twenty Civilian Complaints of Officer Misconduct. Six Of those complaints were sustained.
- Total Number of civilian complaints alleging law enforcement use of excessive force and total number sustained in 2022 – Four Allegations of excessive force. One of those allegations was sustained.
- Total Number of civilian complaints alleging biased policing or racial profiling and the number sustained in 2022 – Two allegation that an Office used racist language or “Racially profiled”. Neither of these complaints were sustained.

- Total Number of civilian complaints alleging criminal conduct and number sustained in 2022 – Zero allegations that Officers engaged in criminal conduct.

Otherwise, as per Section 705 the agency does not compile, maintain, format or organize records in a manner in which you are requesting, i.e., prior to 2021 we did NOT have an electronic reporting system in place to track complaint.
To appeal this response, you must file an appeal with the Pennsylvania Office of Open Records within 15 business days of this response. Please be advised that this correspondence will serve to close this record with our office as permitted by law.
