Pursuant to the Nevada Public Records Act, I hereby request the following records:

Information about any investments (current and within the last 10 years) your institution may have that originate or are linked to companies and organizations located in the State of Israel.

I would like this information in a table with clear headings on:
- The name of the organization/company/institution that the investment has been made in
-How much is the investment
-whether this was a past or current investment
- What is the nature of the investment eg. Education, research, etc.

Furthermore, I would also like a list of universities/ educational institutions (if any) that you have a partnership, “memoranda of understanding” or link with, as well as the nature of the said relationship. A link to these institutions can include formal contracts, research collaborations, academic partnerships or any other relevant connection with an institution.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Request 1: Information about any investments (current and within the last 10 years) your institution may have that originate or are linked to companies and organizations located in the State of Israel. Response 1: The University does not have any responsive records.

Request 2: Furthermore, I would also like a list of universities/ educational institutions (if any) that you have a partnership, “memoranda of understanding” or link with, as well as the nature of the said relationship. A link to these institutions can include formal contracts, research collaborations, academic partnerships or any other relevant connection with an institution.

Response 2: This request is overly broad, in that it fails to provide a reasonable time limitation. The University of Nevada, Reno has been in existence for over 150 years and has entered into innumerable agreements with other universities and education institutions during its existence. The University cannot reasonably be expected to locate and produce every such agreement. Additionally, this request is overly broad, with respect to the phrase “any other relevant connection,” the meaning of which is unclear and not defined in the request. In order to inspect or copy a public record, the specific record must be identified by the person requesting the document. Courts in addressing this issue have held that “agencies are required to disclose only ‘identifiable’ governmental records not otherwise exempt. Wholesale requests for general information to be analyzed, collected and compiled by the responding government entity are not encompassed therein.” See e.g., Hodai v. City of Tucson, C20141225 (Ariz. Super. Ct. 2014) citing MAG Entertainment LLC v. Div. of Alcohol Beverages Control, 868 A.2d 1067, 1076 (N.J. Sup. Ct. App. Div. 2005). A government agency is not required to respond to an overbroad request that does not request specific, identifiable records. Id. at 1074, citing Capitol Info. Assoc. v. Ann Arbor Police, 360 N.W.2d 262, 263 (1985); Rogers v. Superior Court, 23 Cal.Rptr.2d 412 (Cal. App. 4th 1993) ("It makes no sense to permit an individual to make a general, unfocused request for records to the public agency ... [t]he request to the agency must itself be focused and specific.”); see also Nevada Public Records Act: A Manual for State Agencies, pg. 7. Finally, the University does not track its contracts based upon party type (e.g., whether the other party is a university or other educational institution). The University is not required to create data, generate new documents or organize data to create a record that was not in existence at the time of the request. NAC 239.867; Pub. Employees’ Ret. Sys. of Nev. v. Reno Newspapers, Inc., 129 Nev. 833, 840, 313 P.3d 221 (2013). Given all of the above, the University is unable to respond to your request as written.
