• Any written policies or procedures regarding department practices on the acquisition or handling of rape kit evidence, including protocols for its collection, testing, and delegation and transfer to all other relevant locations, laboratories, or agencies

• The number of kits collected and booked into evidence from the period of January 1, 2000 through the date this request is processed

Good Afternoon, This letter is in response to your Public Records Requests to the City of Renton made via email to the Renton Police Department Public Information Officer, Commander Leibman. Summary of Request: Record(s) Requested. (I have numbered your request for convenience) Pursuant to the Washington Public Records Act, I hereby request the following records: Any and all statistics, data, reports, audits, policies, and procedures pertaining to the following items regarding sexual assault evidence collection (SAEC) kits — also known as "rape kits":
* All standard operating procedures regarding the SAEC process
* Any written policies or procedures regarding department practices on the acquisition or handling of rape kit evidence, including protocols for its collection, testing, and delegation and transfer to all other relevant locations, laboratories, or agencies
* The number of kits collected and booked into evidence from the period of January 1, 2000 through the date this request is processed
* The number of kits that have been processed by a public or private crime or forensic laboratory or equivalent processing location from the period of January 1, 2000 through the date this request is processed
* The number of unprocessed kits in any storage facilities currently under the department’s jurisdiction and control, including those held by medical personnel or at external laboratory locations
* Any materials regarding the status or ultimate disposition of cases in which a kit was collected. Please include all available segregable data.
* All audits involving this agency regarding the collection or backlog of SAEC kits All proposed alterations or yet-to-be-implemented changes to the policies and procedures regarding the collection, testing, and use of SAEC kits First Installment Per our letter dated October 29, 2018, the City combined both of your requests into P002350-102918
First Request - Please note:  Commander Leibman received your public records request on October 15, 2018, via email.  He was out of the office and his out of office reply noted an October 23, 2018 return to work date. On October 23, 2018 Commander Leibman forwarded your email to me as a Public Records Request.  The City of Renton uses the GovQA public records system portal. GovQA automatically numbered your October 15, 2018 request as P002350-102918.

Second Request - Please note:  Commander Leibman has been out of the office for extended periods of time in October and November 2018.   In tracking down this request through an email search the City also became aware of your October 22, 2018 email to Commander Leibman indicating that you had made substantially the same request on October 1, 2018.  (You should have received and out of office from Commander Leibman on October 22, 2018 as well) The City cannot locate any email from you on October 1, 2018 regarding this request.

The City provided the First Installment of the following records without exemptions or redactions on October 29, 2018: Lexipol 606 Property and Evidence Lexipol 610 Sexual Assault Investigations
Second Installment The City provided the Second Installment of the following records with redactions on November 8, 2018: Chain of Custody Reports (156 records) – with redactions subject to the redaction log. Please note: The Chain of Custody Reports address request items 3, 4 and 5. Our electronic evidence system, Evidence on Q (EonQ) went live (electronic) in 2011. WIF on Chain of Custody reports indicates Walk-in Freezer. Third Installment and Request for Clarification No. 1

The City provided the Third Installment of the following records with redactions on December 18, 2018: Records responsive to item 6 of your request: The City provides 2 records without exemption or redaction.  These are examples of the first page of SA case reports as listed on the EonQ Chain of Custody Report provided in the Second Installment. The first page of the RPD case report lists the Status and Disposition of each case. Request for Clarification No. 1 Item 6 of your request is for “ any materials regarding the status or ultimate disposition of cases in which a kit was collected” Please clarify if are requesting  the first page of each RPD case report as listed on the EonQ Chain of Custody report in response to item 6? Record responsive to item 7 of your request. SA Kit Inventory 06-02-16 (22 pages with redactions subject to the redaction log)

Fourth Installment and second Request for Clarification No. 1 The City provided the Fourth Installment of the following records on January 17, 2019 with redactions: Freezer 9 Audit (5 pages with redactions) Full Freezer 9 Inventory (13 pages with redactions) Records responsive to item 6 of your request: The City provides 2 records without exemption or redaction.  These are examples of the first page of SA case reports as listed on the EonQ Chain of Custody Report provided in the Second Installment. The first page of the RPD case report lists the Status and Disposition of each case.

NEXT INSTALLMENT. Staff continues the process of locating, reviewing and processing records that may be responsive to your request.   Pursuant to RCW 42.56.520, the Police Department requires additional time to process your request.  The Police Department anticipates a response to your request by 5:00 p.m. on July 26, 2019.  If the records become available sooner, you will be contacted.
