Pursuant to the Rhode Island Access to Public Records Act ("APRA"), I hereby request the following records:

All policies/procedures and associated reporting requirements for facilities under this agency's jurisdiction (including juvenile, privately-operated, and those of various security level) related to the segregation of an inmate/person in custody/offender due to disciplinary, classification, medical, safety, or other reasons. Please include policies/procedures/reporting requirements for all such segregation activities, including, but not limited to, those associated with the following terms:

• solitary
• solitary confinement
• Security Housing Units
• Special Housing Units
• Intensive Management Units
• Restricted Housing Units
• Communication Management Units
• disciplinary segregation
• administrative segregation
• involuntary protective custody

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am responding to your Access to Public Records Request, which I received via email on April 9, 2015 (See below). In your letter you ask for “all policies/procedures and reporting requirements for facilities under this agency’s jurisdiction related to the segregation of an inmate/person in custody/offender due to disciplinary, classification, medical, safety, or other reasons.” You further state in your email that you are seeking records of all such segregation activities, including those associated with solitary, solitary confinement, Security Housing Units, Special Housing Units, Intensive Management Units, Restricted Housing Units, Communication Management Units, disciplinary segregation, administrative segregation, involuntary protective custody.

Attached are the policies and procedures in the possession of the Department of Corrections that relate to your request. I have attached policy #11.01-6, Code of Inmate Discipline; policy #12.01-2, Protective Custody for Inmates; policy #12.02-1, Administrative Confinement – Awaiting Trial; policy #15.11-3, “C” Category Inmates; policy #12.26-4, Special Management of Juvenile Offenders; policy 315.01-6, Classification Process; and, policy #18.43-2, Health Evaluation of Inmates in Administrative or Disciplinary Confinement. You will find reporting forms at the end of each policy. I am able to send these records to you electronically, therefore no fees are due for these documents. Upon receipt, please verify that you have received these records.

In accordance with Rhode Island General Laws §38-2-8, if you are dissatisfied with this response you may wish to file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI, 02903, or the Rhode Island Superior Court of Providence County.
