This email is being written on behalf of the Village of Rosemont in response to your request under the Illinois Freedom of Information Act ("FOIA") that was received by the Village on December 12, 2018. You requested "Records, references and or status of the chlorine gas event of December 7 2014 at the Hyatt in Rosemont IL" including "Any internal reference numbers including but not limited to case, document, filing, archival or docket; Transcript from witness who first reported the incident; Transcript of any related calls to 911; [and] Copies of any reports of threats to the Hyatt or events there within the same week."

Pursuant to 5 ILCS 140/3(e) of the FOIA, the Village is extending the time for responding to your FOIA request an additional five (5) business days from December 19, 2018 to December 27, 2018. The reasons for this extension are the following: (1) your request requires the examination and/or collection of a potentially substantial number of records, including records that are still in the process of being created; (2) the requested records require examination and evaluation by personnel having the necessary competence and discretion to determine if they are exempt from disclosure under the FOIA, or should be revealed only with appropriate deletions; and (3) the request cannot be complied with by the Village of Rosemont within the time limits prescribed by the FOIA without unduly burdening or interfering with the operations of the public body.

To the extent that your FOIA request is being denied, the person responsible for the denial is Matthew Rose, who is one of the Village's attorneys.

To the extent that your FOIA request is being denied, you have the right to have the denial reviewed by the Public Access Counselor at the office of the Illinois Attorney General. The Public Access Counselor's address and telephone number are as follows:

On December 17, 2018, pursuant to Section 3(e) of the FOIA, the Village extended the time for responding to your FOIA request an additional five (5) business days.

You requested "Records, references and or status of the chlorine gas event of December 7 2014 at the Hyatt in Rosemont IL" including "Any internal reference numbers including but not limited to case, document, filing, archival or docket; Transcript from witness who first reported the incident; Transcript of any related calls to 911; [and] Copies of any reports of threats to the Hyatt or events there within the same week."

Your FOIA request is denied. Pursuant to Sections 7(1)(a), 7(1)(b), 7(1)(c), 7(1)(d)(i), 7(1)(d)(iv), 7(1)(d)(v), 7(1)(d)(vii), and 7(1)(d-5), disclosure of the records would interfere with pending or actually and reasonably contemplated law enforcement proceedings conducted by the Village and the Federal Bureau of Investigation ("FBI"), unavoidably disclose the identity of persons who provide information to investigative or law enforcement agencies, disclose unique or specialized investigative techniques, obstruct an ongoing criminal investigation, disclose private and personal information otherwise exempt from disclosure, and disclose FBI records which the FBI has requested be kept confidential due to its ongoing criminal investigation.
