Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following records:

All unedited body-worn camera / bodycam recordings related to the following law enforcement critical incident:

Incident Date: January 06, 2023
Location: 1200 block of South Michigan Avenue, Roswell, NM
Victim Name: Nikolas Acosta

I am specifically requesting the unedited body-worn camera recordings captured by all officers present for the full duration of the incident, including audio recordings associated with the footage.

If any portion of the requested footage must be redacted, I ask that you clearly indicate the portions that have been redacted and provide an explanation of the legal basis for the redactions. If the requested footage is withheld in its entirety, please provide a detailed explanation citing relevant public records exemption(s).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good day,
I have received your request for Inspection of Public Records. We are in the process of gathering that information. I will have a response to you within the time frame designated by the New Mexico Inspection of Public Records Act.
Due to the high volume of lapel video and other requests, it may take us longer than normal to provide the requested records. We hope to have the request completed in a few weeks, but if we can provide the records sooner, we will be in touch.
In response to your inquiry regarding cost, we charge $25 per DVD-R/thumb drive. If you prefer to utilize our website NextRequest, if the file sizes exceed 2GB there is a $25 free, and if the total file sizes exceed 16GB, the there is a $50 fee.

Good morning,

Unfortunately we are still working on getting this request completed. We have been experiencing an extremely high volume of requests the past few months, almost all of which are requests for lapel video. There are approximately twenty requesters ahead of you, and I only have two people employed full time to work on lapel video review and redaction, one of which was only recently hired in response to the increase in requester volume.

Unfortunately we are still very behind on lapel records requests. There are still approximately eighteen requesters ahead of you. We are working as quickly as we can; unfortunately, review and redaction of lapel video is a slow, time consuming process that must be done accurately according to the New Mexico Inspection of Public Records Act.

We will do our best to have your request completed, but it will still take a few weeks. If we are able to complete it sooner, we will definitely be in touch.
