Mr. Schultze,

To simplify our case, I am submitting a new request for the release of records under the California Public Records Act, Gov’t Code §§ 7920.000 et seq., California Penal Code §§832.7-832.8, and Art. I, § 3(b) of the California Constitution. I seek copies of all records in your office’s possession, regardless of who created them. This request is for all District Attorney’s Office “investigative reports,” which you call “memoranda,” summarizing your office’s investigations and conclusions regarding 165 officer-involved shootings and other use-of-force incidents resulting in serious bodily injury or death occurring in San Bernardino County between 2014-2024 listed in the attached csv. It includes incidents previously identified by your office, which are labeled in the “Data From” column as “DA List.”

Please respond to this request in ten days, either by providing the requested information or providing a written response setting forth the specific legal authority on which you rely in failing to disclose each requested record, or by specifying a date in the near future to respond to the request. See Cal. Gov’t Code § 7922. Pursuant to section 7922.600, please disclose all reasonably segregable non-exempt information from any portions of records you claim are exempt from disclosure.

If any records requested above are available in electronic format, please provide them in an electronic format, as provided in Govt. Code § 7922.570. To assist with the prompt release of responsive material, we ask that you make records available to us as you locate them, rather than waiting until all responsive records have been collected and copied.

Just to provide a brief update.

I have gotten through roughly the first 50 names on your spreadsheet. I already have .pdf files of 6 public memoranda that were released, but are simply no longer on our website. (They were all publicly released prior to April of 2020, which is as far back as the news releases on the site go.)

I believe there are likely many more public memoranda, but we will need to find the hard copies. In the past, the memoranda were in each office, rather than centralized.

I am about to start a two-week evidentiary hearing on a habeas corpus case, which will slow my progress. However, I will have our paralegal start looking for the hard copies.
