Pursuant to the California Public Records Act, I hereby request the following records:

Hello,

The roster of sworn police officers from 2016 - 2024
Names, badge numbers, serial numbers, division/station, sworn status.

The department's headshot photos of all of the same officers are referenced above. Duplicates from each year do not need to be completed. At a minimum, photos for 2023 - 2024 should be included.

Precedent: Santa Ana Police Department and LAPD have released their photos. A reminder that nothing in California Penal Code 832.7 mentions photographs in personnel records are kept confidential. Not only that, but videos and pictures of officers are regularly shared on social media.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Hello,

LAPD, Culver City Police Department, Santa Ana PAD, and Garden Grove Police Department have released their photos. Multiple lawsuits to claw back the records citing officer safety have failed. LAPD has also released information about its officers' height, weight, and age. An attempt to not release that information failed in court as well.

"Headshot photos - withheld pursuant to Government Code section 7927.705 [peace officer personnel records] [California Evidence Code sections 1040 and 1043-1047; California Penal Code section 832.7(a)], California Government Code section 7927.700 [personnel, medical or similar files], California Government Code section 7922.000 [personal identifying information]"

The exemptions cited are null if your department publishes videos, photos, and other photographs of your officers online or elsewhere.

Please provide the records as other departments have done. I have attached photos as proof of what's been released by both Culver City and Garden Grove.

Hello,

Your Facebook has formal officer photos posted for the public to see. You cannot pick and choose what is a personnel record. Courts have agreed that photos are not exempt.

There is no invasion of privacy if police can be photographed in public, while working a public job, that you post publicly.

Thank you for your message. The San Diego Police Department stands by its determination of the exemptions cited. Please also note:

The records you requested are withheld pursuant to the following Government Code exemption(s):

Government Code section 3307.5. [Photograph or identity; Internet use]

(a) No public safety officer shall be required as a condition of employment by his or her employing public safety department or other public agency to consent to the use of his or her photograph or identity as a public safety officer on the Internet for any purpose if that officer reasonably believes that the disclosure may result in a threat, harassment, intimidation, or harm to that officer or his or her family.

(b) Based upon his or her reasonable belief that the disclosure of his or her photograph or identity as a public safety officer on the Internet as described in subdivision (a) may result in a threat, harassment, intimidation, or harm, the officer may notify the department or other public agency to cease and desist from that disclosure. After the notification to cease and desist, the officer, a district attorney, or a United States Attorney may seek an injunction prohibiting any official or unofficial use by the department or other public agency on the Internet of his or her photograph or identity as a public safety officer. The court may impose a civil penalty in an amount not to exceed five hundred dollars ($500) per day commencing two working days after the date of receipt of the notification to cease and desist.
