Pursuant to the California Public Records Act, I hereby request the following records:

All cellular text messages sent between Curtis Havel and Marty Plisch between August 18th 2019 and May 17th 2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

If the agency will inspect Curtis Havel's statement to the police regarding an incident that occurred on January 23rd 2020 regarding Summer AKA Erin Lee Fowler at the ACOE, you will see in the message that Curtis Havel states that he received a text message from Marty Plisch about Summer. I will provide below an exact quote of the statement Curtis Havel gave to Law Enforcement regarding the incident:

0936 hours to approximately 1300 hours
Army Corps of Engineers yard, Sausalito
At 0936 hours, I received a text message from Marty Plisch (Army Corps) informing me that Erin "Summer" Fowler
was on the vessel "Liberte" (CF 7379CU)*. Mr. Plisch clarified that Ms. Fowler had not obtained permission to enter
the Army Corps of Engineers (ACOE) yard. I clarified that Ms. Fowler had not contacted me about entering the yard or
boarding the vessel. Mr. Plisch requested my presence at the yard and recommended contacting law enforcement.
I was aboard the Richardson's Bay Regional Agency's (RBRA) patrol vessel when I received Mr. Plisch's text message
and headed directly for the ACOE yard. On the way to the ACOE yard, I contacted the Sausalito Police Department.
I arrived at the ACOE yard at approximately 0940 hours while still on the phone with dispatch. I observed Ms. Fowler
in the cockpit of "Liberte" and described her appearance to dispatch (female, red hair, approximately 5 feet 6-inches tall,
approximately 30-35 years old, grey sweatpants, and a white lace blouse and black tank top underneath an olive green
overcoat). Three officers from the Sausalito Police Department (Corporal Padilla, Officer Fotherby and Officer Walsh)
arrived at approximately 0945 hours."

In this quote, it is clear that there is text communication between Havel and Plisch occurred. That strongly suggests these records exist and so I appeal and maintain that these records should be released.
