We have carefully reviewed your public records request and determined that the Santa Monica Police Department does not maintain records with the data fields and in the format that you are requesting.

It is well established principle that while public agencies must provide access to their existing records, they are not required to create new records to satisfy public records requests. (Gov. Code, § 6252, subd. (e); Haynie v. Superior Court (2001) 26 Cal.4th 1061, 1075; Sander v. Superior Court (2018) 26 Cal.App.5th 651, 665 (“ Sander”).) In response to public record requests, a public agency is not required to change the substantive content of existing records or replace existing data with new data to create new records that the City does not use. ( Sander at p. 669.) The Act also does not require that the City answer questions, perform research, compile data, or produce records that may be created in the future.

To create the requested records, the City would do more than simply gather raw data from a database and segregate disclosable data. Rather, the City would need to perform research to identify new data and manipulate existing raw data to prepare the reports with the data fields that you are requesting. SMPD does not currently report NIBRS. In essence, the City would need to change substantive content and restructure content of existing raw data. Moreover, to generate a report with all of the data that you seek SMPD would need review police reports and compile data. The Public Records Act does not require the City to compile data or create reports that the City does not use for its operations.
