Pursuant to the Washington Public Records Act, I hereby request the following records:
Regarding Officer Clayton Agate #6655, I am requesting:
1. For every conversation in the officer’s Signal app, including archived and deleted conversations, please provide:
1a. The title, avatar, description, and retention period set for the chat.
1b. A listing of all members in the chat.
1c. All messages, images, and files sent and received in the chat, sufficient to discern sender’s name and avatar, time received, and message content, as well as events including but not limited to entering and leaving chat, changing retention time, etc.
2. The list of all contacts in the officer’s Signal app. This can be found by clicking the “New Message” icon.
3. The name, avatar, and username set for the officer themself. This can be found by clicking the profile icon.
If copying these messages by hand is burdensome, I understand that SPD owns software tools that can be used to extract these records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We do not have a record or the ability to readily create a record that contains the information you are seeking. The Public Record Act does not require us to perform research projects or develop data for information requests. RCW 42.56.080. A search of Detective Agate's phone was completed and no responsive records were located.

Hello Justin,
Thank you for the quick follow up. I was made aware that the city-owned phone assigned to Mr. Agate was observed running the Signal encrypted messaging app in at least 2021. Would you please check again to see whether the app is installed on his phone?
May I remind you and Mr. Agate that destruction of public records in Washington state carries criminal penalties for the willful and unlawful destruction of public records under RCW 40.16.020.
