In order of preference, I would prefer that this data be provided as: OpenDocument spreadsheet, plain text with comma-separated-values (i.e., a "CSV" file), Excel spreadsheet, or the native electronic format of the software from which this information is retrieved in fulfillment of my request. I specifically request that you not create a new record for me by rendering to PDF or by printing your electronic record then scanning it to make a series of images of the printed data.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello,
This is in response to your request that SPD  provide records responsive to your requests by delivering them via email, only. SPD currently provides responses to requests for records by providing them via GovQA download or by physically mailing them on a CD.

Nothing in the PRA obligates an agency to provide a record in a particular electronic format. Mechling v. City of Monroe, 152 Wn. App. 830, 847-50, 222 P.3d 808, 816-18 (2009). In fact, government agencies have discretion regarding record formatting and are not required to provide records in the electronic format demanded by a requestor. Mitchell v. Dep't of Corr., 164 Wn.App. 597, 606–07, 277 P.3d 670 (2011). The Washington Attorney General’s Model Rules, which are not binding on local agencies, suggest that agencies provide records in electronic if it is reasonable and technically feasible to do so. WAC 44–14–05001.  The Model Rules do not direct a particular format for that delivery; they merely describe that agencies can provide copies of electronic records in an electronic format that is used by the agency.  WAC 44-14-050(2), WAC 44-14-07003.  SPD uses GovQA download and CD delivery of records due to operational purposes.

RCW 42.56.100 states that agencies shall not only provide “fullest assistance” to requestors. That same statute also requires agencies to adopt rules and regulations “to protect public records from damage or disorganization, and to prevent excessive interference with other essential functions of the agency.” SPD has determined that it is not reasonable and technically feasible to provide records to you via email. We have found, as many other Washington agencies have, that providing records via GovQA and CD provides reliability in delivery. That is, we can establish that either the records were mailed to the requester via U.S. mail, or picked up at our office, or use the tracking and delivery functions of GovQA.  Finally, it may be helpful to understand that the PRA requires agencies to treat requesters the same, absent a law authorizing otherwise.  RCW 42.56.080.  As a consequence, SPD is unable to treat you differently than we do other requesters in how we are responding to your request for electronic records.  So, as we do with other requesters seeking copies of records under the PRA, we are making the records you requested available to you via GovQA or CD.
