Pursuant to the Florida Sunshine Law, I hereby request the following records:

1) Your agency's contract and statement of work with ZeroEyes Inc. for the provision of the ZeroEyes automatic weapon detection systems.

2) Detection data from your agency's ZeroEyes system showing:

a) The number of scans conducted by the Zero Eyes system since its installation
b) The number of true positive detections made by the ZeroEyes system (a true positive is an event in which the system correctly identified a weapon)
b) The number of false positive detections made by the ZeroEyes system (a false positive is an event in which the system incorrectly identified a non-weapon object as a weapon)
c) The number of false negative events (a false negative is an event in which the system failed to detect a weapon)

Please provide the data broken down by month, if available, and by year if not available by month.

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

If you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation of the employee hours required to fulfill the request.

If you choose to reject this request or redact portions of responsive documents, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Carolyn,

Thank you very much for your help with this request.

The records you provides suggest that the district does have data responsive to item 2 of my request. Exhibit C of the contract you provided states:

"2.2 Weapons Detection and Image Screening.

As part of the Subscription Services, upon receiving an Image from the Equipment, Contractor will provide the following services to SBSC:

(a) Promptly after receiving such Image from the Equipment, the Operator will view the Image in an attempt to determine if the Image portrays someone with a Weapon. If the Operator determines that there is reasonable cause to conclude that the Image portrays someone with a Weapon, the Operator will initiate an Alert and transmit Data to the Authorized Users in accordance with the Contractor's then current policies, procedures or practices and thereafter continue to transmit such additional Alerts and Data as may be received from the Equipment. Contractor will transmit all Alerts and Data in accordance with the Contractor's then current policies, procedures or practices applicable to the transmission of Alerts and Data.

(b) If after reviewing the Image received from the Equipment the Operater determines that there is reasonable cause to conclude that the Image does not portray someone with a Weapon, Operator will take no further action (other than to log the Image). Operater will make all such determinations in Operator's sole and absolute discretion."

Documentatiuon of the number o flogged images, the number of alerts, and other data transmitted as a result of alerts is responsive to item 2 of my request.

Our Public Records Custodian, Carolyn Bedsole, has referred your email below to us for response.

As previously stated, Seminole County Public Schools does not maintain the documentation you have requested depicting the number of “detection” events as defined by your request. We do maintain the actual detection alert notifications. However, these alerts contain information that could reveal the capabilities and vulnerabilities of our school security system and are therefore exempt from production as a public record pursuant to section 119.071(3)(a), Florida Statutes (2024). See also, Central Florida Regional Transportation Authority v. Post-Newsweek Stations, Orlando, Inc., 157 So. 3d 401 (Fla. 5th DCA 2015); State Attorney’s Office of the Seventeenth Judicial Circuit v. Cable News Network, Inc., 251 So. 3d 205 (Fla. 4th DCA 2018); Op. Att'y Gen. Fla. AGO 15-06 (2015).

Consequently, we are in possession of no additional non-exempt records that would satisfy your request and will not be providing any further response.

Hello Gregg,

Thank you for your response. What specific information contained in the email alerts do you believe would reveal the capabilities and vulnerabilities of the school security system, and therefore be exempt under section 119.071(3)(a)?

At a minimum, if you consider the emails themselves exempt I will accept a data extract from your email client showing the number of alert emails sent by the ZeroEyes system and the associated metadata (e.g. date, subject line, sender/recipient, etc.).

If you could confirm receipt of this message and that you are processing the request for the email metadata I would greatly appreciate it.

The alerts contain surveillance camera images and an analysis of the content of the image. This falls squarely into protected security system information as referenced in the cases and AGO I sent you and is therefore exempt from public records.

I will research your new metadata request and advise.

We have researched our records, and with the exception of one notification from October 2023, we do not maintain alerts from the ZeroEyes system on our servers. Weapon detection alerts are sent directly from Zeroeyes to law enforcement personnel.

The metadata from the October 2023 alert is attached hereto and we believe that this fully responds to your revised request of August 19.
