Pursuant to the South Carolina Freedom of Information Act, I hereby request the following records:

All Stand Your Ground motions that have been filed by defendants in judicial district 16 since January 1, 2006.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Mr. Spies:

Your FOIA request was forwarded to me by Union County Clerk of Court Melanie
Lawson. You requested all records from "Judicial District 16." In South
Carolina, the 16th Judicial Circuit consists of Union County and York
County. I am providing a response from Union County. Should you wish to
ask for records from York County, you would need to file a separate request
there.

Any "Stand Your Ground" motion filed in a Union County General Sessions case
would be stored in the file of the individual Defendant in whose case the
motion was made. Those files are public records kept in Union County Clerk
of Court's Office. Pursuant to S.C. Code Section 30-4-30(a), you may come
to Union and review the Defendant files for "Stand Your Ground" motions. I
know of no way, however, to advise you of the specific cases in which such a
motion was made.

I have been the Deputy Solicitor in Union County for the past ten years. We
have had several cases which raised "Stand Your Ground" issues, but I do not
recall any cases in which a hearing was held on a Defendant's immunity from
prosecution claim or a written motion was filed asserting immunity.
