This is to advise that the ordinance pertaining to Chronic Nuisance Properties under Chapter 10.68 is available by accessing your account via the My Request Center on the City’s public records request portal (GovQA).

With respect to the portion of your request which states “Please provide any and all written records (including but not limited….emails…,” clarification is needed to enable City staff to perform an adequate search for any emails you may be seeking under your request. We note that your request states “Any and all records for the past year…,” did you wish for staff to utilize the time frame of 4/10/2022 – 4/10/2023 (date of your request)? Further, we note that you request did not provide search terms under which you wish for us to perform an email search. If we were to utilize "C36289" OR "Chronic Nuisance Properties" OR Chapter 10.68 as the search terms, would this be satisfactory to you, or do you have additional search terms you would like us to utilize for the email search of our email retention system?  Please confirm if you are satisfied with the date range and search terms or if you like to make any modifications.  We will await to hear from you in this regard before proceeding with an email search.  Please note, pending clarification from you, that once emails are compiled, they will be reviewed for responsiveness to your request and for any exempt information.

This is to advise that the City’s IT Department performed a search for emails in the City’s Enterprise Vault system (email storage system) based on the information provided in your April 23 clarification and utilizing the following parameters:

Time Frame: 4/22/2023 - 4/22/2024

The search returned approximately 1,500 emails. The emails will now need to be reviewed for responsiveness to your request and for any exempt information. You are welcome to modify the above search parameters. Police Records Unit staff have advised case 2023-20222196 is not being provided as it is currently under and open/active investigation. Records contained in an active, ongoing criminal investigation are exempt.  These records relate to an open criminal investigation and the withholding of the records while this investigation is ongoing is essential to effective law enforcement.  Disclosure at this time would make confidential information known to individuals without such knowledge, thereby placing at risk the department’s search for the truth and jeopardizing the integrity of the investigation. This information is exempt pursuant to RCW 42.56.240(1), Newman v. King City, 133 Wn. 2d 565, 947 P .2d 712 (1997).

This is a follow up to my January 6, 2025, message to you regarding your April 10, 2024, public records request assigned tracking number P003786-041024.

This is to advise that a seventh installment of responsive records, which consists of a sixth installment of emails, is available by accessing your account via the My Request Center on the City’s public records request portal (GovQA).

Upon review of the history of your GovQA account, it appears that you the viewing your request and the last time the request was viewed was on January 6, 2025. However, it appears that you have not viewed the fifth through seventh installment of records that were made available to you on September 20, 2024, November 12, and January 6, 2025. In order for City Clerk staff to see that you are viewing documents under your request, you will need to actively click on that request along with the documents that are being provided to you under that request. We notice that the last time you viewed records under your request was July 19, 2025. As you have not viewed records since July 19, we have suspended work on your request.

Section 6.1.6 of the City's Public Records Request Policy and Procedures states, in part, the following:

6.1.6 Inspection of records.

. . .
b. The requestor must claim or review the assembled records within thirty (30) days of the City’s notification to him or her that the records are available for inspection or copying. The City will notify the requestor in writing of this requirement and inform the requestor that he or she should contact the City to make arrangements to claim or review the records. If the requestor or a representative of the requestor fails to claim or review the records within the thirty (30)-day period or make other arrangements, the City may close the request and refile the assembled records. Other public records requests can be processed ahead of a subsequent request by the same person for the same or almost identical records, which can be processed as a new request. If the requestor fails to clarify an unclear request within thirty (30) days of the City’s request for clarification, the City may consider the request abandoned after sending a closing letter to the requestor.

Please advise as soon as possible, but within 30 days of today's date, or by April 2, 2025, if you wish to proceed with your request. If we have not received confirmation from you that you wish to continue with your request and/or you have not viewed the fifth through eighth installment of records by April 2, we will subsequently follow up with you and abandon your request and subsequently close it.
