Pursuant to the California Public Records Act, I hereby request the following records:

I am seeking your assistance in obtaining E911 Audio (Audio of callers, dispatch, et. el.) for calls placed to the Sunnyvale DPS Dispatch center. I am able to receive these files via USB, CD, DVD, or other digital formats, if available. I am requesting, specifically, audio from the dates of December 5th, 6th, and 7th. in the year 2022. As law requires, the retention of E911 audio should be available for no less than one year, this request will hopefully be fairly easy to fulfill.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

There were 349 calls made to the agency on December 5-7, 2022. This will take significant time to go through the calls to determine which calls can be released to you. Our agency does not release any 911 calls related to criminal cases (reference to Gov. Code, §§ 7923.600-7923.625 (formerly Gov. Code, § 6254(f)); Haynie v. Superior Court (2001) 26 Cal.4th 1061). Yes

Calls in which "911" was dialed, or if it's referred to as E911, or PSAP, any of those should help narrow the focus a bit. Emergency only.

* Calls from Field Units to Dispatch?
If available as well; Yes

* Are you also requesting Radio Traffic in addition to phone calls?

With regards to the dates, I thought adding "UTC" would have helped as it is typically a standardized time. However, this appears to be causing confusion, so I will restate that the dates and times of interest are:

DECEMBER 5: 8PM Pacific to 1:00AM Pacific (Rolling in to following Day)
DECEMBER 6: 8PM Pacific to 1:00AM Pacific (Rolling in to following Day)
DECEMBER 7: 8PM Pacific to 1:00AM Pacific (Rolling in to following Day)

Thank you for the follow-up and files provided so far. I have been reviewing the audio and very much appreciate your hard work on this request. I am not sure if our systems may have missed your attachments, but I noticed that there are no other Radio Traffic files past "(Redaction)_SV223400206_Radio_Traffic.wav.m4a"

Was the original old file possibly attached to the follow-up email? If not, it might just need a different OneDrive folder share name, but I'm not very familiar with our new systems.

Thanks for your response. Indeed you've included every 911 call requested and I am grateful for the amount of time you spent on this. The files I'm mentioning are:

Whereas the second batch of calls and radio traffic you provided (December emails) came with both 911 calls as well as the radio traffic, the above batch of calls did not. For example:

The Radio Traffic portion seems to be missing. Did it hopefully get processed and saved somewhere accessible, but possibly just not attached? If the files can be found, please attach them when you can.

If the files are no longer available, I'm not going to request that you re-work this request, rest assured. However, I am hopeful that the other data may be available and that this might just have an easy resolution!
