Pursuant to the California Public Records Act (California Government Code ยงยง 6250), I hereby request the following records:

- A list of all arrest-related deaths during incidents involving Tehachapi PD officers since 2004.
- A list of all homicides by Tehachapi PD officers since 2004.
- A list of all officer-involved shootings by Tehachapi PD officers since 2004.
- A list of all complaints made by civilians against Tehachapi PD officers alleging excessive or inappropriate use of force since 2004, including outcomes of any subsequent inquiries.

In each case, please provide as much detail as is possible, including but not limited to: date of incident, street address of incident, identities/ages/sexes/races of the deputies and civilians involved, weapons used, circumstances of incident, police incident report or officer's narrative.

If fulfilling part of this request should delay your expected response time, please do not wait until all the information is available but rather release elements as they become available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Ms. Thomas--

Your records request to the Tehachapi Police Department has been referred to me for review. I have consulted with the police chief. You are asking for records back to 2004. Additionally, this will take hand searching through all complaints. Given the foregoing, I hereby extend the time in which the City has to respond to your request from November 9, 2015 to and through November 23, 2015 pursuant to California Government Code Section 6253(c)(2).

I am the City Attorney for the City of Tehachapi. In reply to your request below, please be advised that Peter Graff was involved in an officer-involved homicide in 2015. Michael Christian and Michael Adams were involved in officer involved shootings in 2015. The remainder of your request concerning complaints by civilians is not public information, see Long Beach Police Officer's Associate v City of Long Beach (2014) 59 C 4th 59.

Do you anticipate that you will be able to respond to the remainder of my original request? That is, a list of all homicides by officers, arrest-related deaths and officer-involved shootings dating back to 2004?

So just to check: are you saying there have been three officer-involved shootings in 2015 after zero in the years 2004-2014?

The Tehachapi Police Department had two Officer Involved shootings in 2015. One shooting involved Officer Peter Graff and the other shooting involved Officer Michael Christian and Officer Michael Adams. The Department does not have any information on officer involved shootings for the years 2004-2007 due to the fact that the Department did not exist and police services were provided by Kern County Sheriff.
