To Beryl Lipton:
Please be advised that your records request was actually received by the Agency on June 16, 2016. It appears from the email string below that you attempted contact prior to that date, but there is no evidence that contact was ever actually made with the Agency. June 16, 2016 is the first time this information was received and forwarded to me for review, so for purposes of the statute, June 16, 2016 shall be the official date of notification to the Agency regarding this request.
Tennessee Code Annotated §10-7-503 states that the custodian of a public record or the custodian's designee shall promptly make available for inspection any public record not specifically exempt from disclosure. In the event it is not practicable for the record to be made promptly available for inspection, the custodian shall within seven (7) business days make such records available, deny such request in writing, or furnish the requester with a response stating the time reasonably necessary to produce such record or information.
You have asked for "any and all databases, spreadsheets, reports, or other consolidated data sets regarding animal control activity within this jurisdiction and any applicable subdivisions for the period from January 1, 2015 through the date this request is processed. Please provide all available segregable information for all removal and/or destruction events, including those conducted by citizens within the jurisdiction. Please include all other available segregable information, including but not limited to, the location of the event, the date of the event, the number and type of creature involved, and any other available data."
It can only be assumed that you are asking for statewide data, if such exists, as opposed to data for specific regions and/or counties. If that is not correct, or if you wish to clarify or refine your request in an effort to minimize reproduction costs, please let me know.
We are currently in the process of determining if there are records pertinent to your request. If such records exist, then those must be reviewed prior to any reproduction of the same. In accordance with the above-cited law, this communication is being sent to inform you that the records you have requested to receive copies of will be made available to you no later than July 20, 2016. If reproduction charges apply, you will be provided with an invoice and payment will be expected prior to the records being produced. Payment shall be made in accordance with TWRA Rule 1660-03-01 governing access to public records, which you may access via our website http://www.tn.gov/twra/article/rules-regulations.
Please contact me if you have any questions or need further assistance.
