Pursuant to the Texas Public Information Act, I hereby request the following records:

CONTRACTS and AGREEMENTS
• All contracts, licenses, MOUs, MOAs, data agreements, letters of intent, State of Work documents, Scope of Work documents, and other agreement documents with GoGuardian or Liminex that were active any time between 1/1/2018 and 5/23/2024.

TERMS OF SERVICE
• All terms of service agreement documents with GoGuardian or Liminex that were active between 1/1/2018 and 5/23/2024.

FINANCIAL MATERIALS
• All financial documents or records of financial transactions, exchanges or obligations related to GoGuardian or Liminex. Responsive materials include all invoices, bills, receipts, check stubs, or any other records, including those possessed in an electronic format. Responsive materials include any records related to the funding of GoGuardian or Liminex-related technologies, partnerships, and subscriptions, including those related to civil asset forfeiture funds, grants, and any other funding sources.

MARKETING and PROMOTION MATERIALS
• All promotional, descriptive, and marketing materials in the possession of this agency related to and/or referencing “GoGuardian" or "Liminex" and any of its products and services. This includes all presentations, marketing materials, technical documentation, proposals, or similar records shared with this agency and/or any representative thereof by GoGuardian or Liminexa nd any representative thereof.

GUIDING DOCUMENTATION and POLICIES
• All policies, memorandums of understanding, and other guidance materials generated by this agency and/or entity operating on its behalf regarding the acquisition and use of any data or services provided by GoGuardian or Liminex and any representative thereof or any subdivision thereof. Responsive materials include, but are not limited to, any data-sharing agreements, terms of use, licensing agreements, data retention policies, and any other guiding materials, such as user manuals, other guidance materials, help documents, or related materials.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear MuckRock News:

On May 23, 2024, the Texas Education Agency (TEA) received your request for public information. A copy of your request is enclosed.

A deposit or bond is authorized under Section 552.263 of the Texas Public Information Act (Act) under two conditions:

1. When TEA provides you an itemized cost estimate and the charges are estimated to exceed $100.00, TEA may require a deposit or bond for payment before preparing the information for your new request.
2. When you have accumulated unpaid amounts that exceed $100.00 that you owe to TEA in relation to previous requests that you have made under the Act, TEA may require a deposit or bond before preparing information for your new request.

TEA has determined that you meet the following condition:

Unpaid Debt Exceeds $100.00. Therefore, TEA requests full payment of the total amount owed to TEA as authorized by TAC §111.67. This amount is stated on the Cost Estimate Statement enclosed with this letter.

When TEA receives your deposit or bond, TEA will begin to prepare the information for your new request. If TEA cannot provide the information to you within 10 business days from the date your deposit or bond is received, TEA will inform you, in writing, of the date and time the information will be available.

10-day Timeline: If TEA does not receive a deposit or bond before the 10th business day after you receive this letter your new request is automatically withdrawn and closed.

Dear MuckRock MuckRock News:

On June 4, 2024, the Texas Education Agency (TEA) received your bond payment. TEA received a public information request on May 23, regarding documents and contracts with GoGuardian or Liminex that were active between 1/1/2018 and 5/23/2024. To the extent it exists, the requested information is provided to you with this letter and includes a copy of the original request.

Attached are spreadsheets reflecting transactions of school district purchases where the districts requested a disbursement of their Instructional Materials and Technology Allotment. Note, TEA does not maintain records at the state level beyond these transactions. The contracts are between the school districts or local education agencies and the vendors.

Districts and open-enrollment charter schools can use their Instructional Materials and Technology Allotment<https://tea.texas.gov/academics/instructional-materials/2024-2025-instructional-materials-technology-allotment.pdf> (PDF) to order materials through EMAT. The funds can be accessed in two ways: through a requisition for state-adopted materials or through a disbursement request for materials ordered directly from the vendor.
Requisition Process

1. A local education agency (LEA) logs in to EMAT to submit a requisition for state-adopted materials.
2. Funds are deducted from the LEA's allotment in EMAT.
3. TEA reviews the requisition.
4. If approved, TEA sends the order to the publisher. The publisher fulfills the order. TEA pays the publisher.
Disbursement Process

1. LEA logs into EMAT to submit a disbursement request.
2. Funds are deducted from the LEA's allotment in EMAT.
3. TEA reviews the request and contacts the LEA for additional information if needed.
4. If approved, TEA sends the funds to the LEA. The LEA orders directly from the vendor and pays the vendor directly.
TEA pays for interstate and intrastate shipping of instructional materials. Refer to the Freight Information page for shipping details.
These records represent a "Disbursement Process" by an LEA therefore no contact exists between TEA and the vendors.
Referral to another governmental body: The district administrative offices, may have contract information related to your request. A listing of school district contact information is available in the Texas Education Directory, linked here: http://tea4avholly.tea.state.tx.us/tea.askted.web/Forms/Home.aspx.
There are no charges for fulfilling this request and PIR # 69130 is considered closed.
