In regards to RFO No.304-18-1374YR - Request for Offers Open Records Tracking System, I would like to request the following:
1) Any and all records or correspondence both written and electronic(emails) regarding the vendor selection and contracting for new Public Records processing system.
2) Any and all records or correspondence both written and electronic(emails) regarding the implementation of new Public Records processing system.
3) Any and all records or correspondence both written and electronic(emails) regarding Vendor’s Application(Software) Security of new Public Records processing system. Please also include any mention of the usage of open-source code by the Vendor.
4) Any and all records or correspondence both written and electronic(emails) regarding Vendor’s Cloud/Hosting Security of new Public Records processing system.
5) Any and all records or correspondence both written and electronic(emails) regarding Vendor’s Personnel Data Access Security Policies and Procedures of new Public Records processing system.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

You have asked for “[A]ny and all records” concerning vendor selection and contracting; implementation; and certain security and access issues. This would encompass both internal and external communications. Based on the terms of your request, below, some of the communications that may be at issue could include attorney-client protected communications between the agency’s employees and agency attorneys. Some of the communications that may be at issue may be communications with the Information Security Office and/or the Information Technology Division concerning security systems. Some of the communications at issue may include internal communications of a policymaking nature.

Attorney-client communications may be protected from public disclosure under Texas Government Code Section 552.107. Certain types of information related to computer network security or the design, operation, or defense of a computer network may be protected from public disclosure under Texas Government Code Section 552.139. Internal communications of a policymaking nature that contain advice, opinion, or recommendations may be protected from disclosure under Texas Government Code Section 552.111. If records that are protected from disclosure are included in your request, I will refer your request, at least in part, to the Texas Attorney General’s Office for a ruling as to those records.

Please clarify as to whether you are seeking records responsive to your request that are public in nature only OR if you are seeking records responsive to your request that include protected records as outlined above.
