From: Matthew Petti

To Whom It May Concern:

Pursuant to the Texas Public Information Act, I hereby request the following records:

All emails sent or received by employees of your agency between December 1, 2014 and the date this request is processed containing the non-case-sensitive phrase "shitcoin."

Please include any attachments to the emails as well.

If any part of these documents are exempt from disclosure, please be sure to review and release all reasonably segregable nonexempt portions of responsive documents.

I request that I be properly classified as a media requester. I am a reporter who has written numerous articles on topics of public interest for Responsible Statecraft, the Daily Beast, the Asia Times, the National Interest, Reason Magazine, America Magazine and the Armenian Weekly, and I am requesting these documents in an editorial capacity. Please contact me if you have any questions about my media status.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Matthew Petti

Mr. Petti, we have received your request.

So that we can process your request please respond to the following requests/questions.

Please clarify if you are requesting only external emails (i.e., emails sent by outside third parties to employees of the Agency, and emails sent by employees of the Agency to outside third parties).

Or, are you also requesting internal emails (i.e., emails sent/received between/among agency employees, but not to/from outside parties)

Finally, it sounds like from your request that you are excluding from your request information contained in agency records which is confidential and exempt from disclosure pursuant to the Texas Public Information Act.
But you do want to include public, non-confidential information contained in mixed records (i.e., agency records that contain a mix of both confidential and non-confidential information)

Please confirm that this is correct.
Thanks, Cheryn Netz

This email consists of a request for a clarification of a Public Information Act request. Failure to respond to this clarification in writing within 60 days will result in a withdrawal of the request.

From: Matthew Petti

Ms. Netz,

Thank you for your prompt response. To clarify, I am requesting both internal and external emails. I am indeed excluding information contained in agency records which is confidential and exempt from disclosure pursuant to the Texas Public Information Act, but do want to include public, non-confidential information contained in mixed records.

If you have any more questions, or think that this request can be further adjusted to make this process move more smoothly for the both of us, please feel free to reach out. I'm happy to talk on the phone at a time of your convenience.

Best regards,
Matthew

Thank you for clarifying your request. The Agency has conducted a search of its email records (which would include attachments) for records responsive to your request, as clarified (the “request”). This search was conducted electronically by our IT department.

After conducting this search we did not find any records, or information within such records, that are responsive to your request.

I also wanted to inform you that the Agency has not taken any enforcement actions that contain this particular search term, and the Agency has not issued any press releases or investor alerts that contain this particular search term.

I hope this information is helpful,

Sincerely, Cheryn Netz
