• A copy of any cost complaint(s) as articulated in section 552.2615 of the Texas Government Code, filed against Texas City, TX alleging any violation of the Texas’s Public Information Act between January 1, 2016 to June 01, 2023.

• Any internal document or email generated by the Texas Attorney Office in response to the above Complaint(s).

• This request includes, but not limited to:

o Any document or email sent to, or received from the Complainant.
o Any document or email sent to, or received from Texas City, TX.
o Any document or email sent to, or received from the Galveston County District Attorney’s Office.
o Any internal document or email generated by the Texas Attorney General Open Records Division in response to the Complaint(s).

o Tracking Sheets that are subject to attorney-client privilege and as defined in OR2019-17141.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

This e-mail is in response to your public information request to the Office of the Attorney General (“OAG”), received by the OAG on June 1, 2023.

The OAG has reviewed its files and has located the attached documents that are responsive to your request.  Although the Public Information Act allows a governmental body to charge for providing documents under certain circumstances, the attached documents are being provided to you at no charge.

The OAG has redacted account numbers that are confidential under section 552.136 of the Government Code.  Because our office is prohibited by law from releasing this information to you, we have removed it from the attached documents.  Normally, we must request a ruling from the Open Records Division before we can withhold information.  However, section 552.136 allows us to withhold this specific information without requesting a ruling from the Open Records Division.  You have the right to appeal our decision to withhold this information from you.  Instructions for appeal are attached.  If you do not want to appeal, you do not need to do anything else.  Please note that we are only withholding a specific category of information that is confidential under section 552.136.

Please note the OAG has also redacted personal e-mail addresses from the attached documents pursuant to section 552.137 of the Government Code and the previous determination issued by the Open Records Division.  See Open Records Decision No. 684 (2009) (governmental bodies may withhold certain information without necessity of requesting decision from Open Records Division).
