The processing notes and tracking file for my previous FOIA request 16-JSC-F-00678.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is an appeal under the Freedom of Information Act about my request 16-JSC-F-00787 processed by Johnson Space Center.
I do not believe the requested records would "not be available by law to a party other than an agency in litigation with the agency."
The requested type of records is routinely disclosed by other FOIA offices and are not classified as attorney work-product, attorney-client communications, or subject to the deliberative process privilege.
Since the determination of my original FOIA request (16-JSC-F-00678) was that there are no responsive documents, there should have been no review by lawyers, and there should have been no predecisional deliberation on legal or policy matters that were antecedent to the adoption of an agency policy.
Therefore I believe that the assertion of exemption (b)(5) is not a valid. Please remand this request to the responding office for a full release of the responsive records.
