From: T. McElwee
To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
The most recent reports pursuant to 21 U.S. Code § 1704(d) requiring an "accounting of funds expended."
These reports are:
1) Those reports submitted by each National Drug Control Program agency to the Director, and which were due February 1, 2022; and
2) The single report by the Director, incorporating the above reports, which was due for the submission to the U.S. Congress on April 1, 2022.
I request these reports be sent, if practicable, in formats as close to the original as possible (i.e., copies of the original PDF's or Excel files, rather than scanned copies). Should records be voluminous, I consent in advance to a rolling release of records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
T. McElwee

To Whom It May Concern:
I wanted to follow up on the following Freedom of Information Act request, copied below, and originally submitted on May 26, 2022. Please let me know when I can expect to receive a response.
Thanks for your help, and let me know if further clarification is needed.
From: T. McElwee
To Whom It May Concern,
On May 26, 2022, I submitted the below request under the Freedom of Information Act.
Despite my correspondence (also included below), I have received no acknowledgement of my request and it has not been given a final determination nor have I been furnished an estimated completion date.
Over twenty working days have elapsed without a substantive determination, I am appealing the constructive denial of my request, and asking for a determination that the agency must respond to my request, providing the documents or outlining reasons that they are exempt.
Best,
T. McElwee
