This is a request under the Freedom of Information Act. I hereby request the following records:

The 31 comment letters received on proposed guidance, issued September 7, 2000 by the federal banking agencies, concerning the allowance for loan and lease losses (ALLL).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Please be advised that Staff searched Council records and made suitable inquiries, but found no documents that are responsive to your request. You may be interested to know that comment letters received over 10 years ago are no longer retained by the Council. Accordingly, I cannot provide you with any information. A determination that no responsive records exist is considered to be an “adverse determination” under the Act. You may appeal this determination in accordance with section 1104.4(b) (3)(vi) of the Council’s Rules on Disclosure of Information, Policies, and Records, which is available on the Council’s Website at this URL: http://www.ffiec.gov/foia.htm.
