Pursuant to the Freedom of Information Act, I hereby request the following records:

All complaints concerning heat and high temperatures submitted to the Occupational Safety and Health Administration from farmworkers who work in greenhouses and plant nurseries, between May 1st, 2023 and the date that this request is processed.

I'm a journalist with Civil Eats, and this information will be used to further my reporting in the public interest.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This letter is to acknowledge receipt of your May 24, 2024, Freedom of Information Act (FOIA) request, which was received in the Occupational Safety and Health Administration's (OSHA), Directorate of Enforcement Programs (DEP) for response. You request the following:

All complaints concerning heat and high temperatures submitted to the Occupational Safety and Health Administration from farmworkers who work in greenhouses and plant nurseries between May 1, 2023, and the date that this request is processed.

Please be advised that in order for DEP to process your request, NAICS code 111421 (nursery/ tree production), 111422 (floriculture production), 111998 (miscellaneous farming - including greenhouse, nursery & floriculture products) will be used to identify complaints in this sector.

We have an existing backlog of FOIA requests in queue received prior to yours, so there is an expected delay. Additionally, all FOIAs are reviewed by the Office of the Solicitor prior to release, which may protract processing time. Please keep these considerations in mind as you await your response.
