From: Silvia Vinas
To Whom It May Concern:
This is a request under the Freedom of Information Act. I hereby request the following records:
All complaints and allegations by individuals in CBP custody made through the CBP Complaint System from 2012 to the present (end of 2017).
Page 10 of the "May 2014 through December 2015 Sexual abuse and Assault in Holding Facilities Report" states that:
"CBP has improved the CBP public complaint system that
serves as an alternative method for individuals in CBP custody to report detention related
concerns, including allegations of sexual abuse and assault, directly to CBP. A Spanish
language complaint mechanism is now available on CBP.gov called “Comunicarse con
Nosotros” which allows for direct submission of complaints in Spanish. The CBP Info
Center administers the program and has dedicated Spanish speaking personnel to process
the complaints and route appropriately."
Please include complaints filed in Spanish through this new complaint mechanism.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Silvia Vinas

Hi Catherine,
Thank you for your response. I don't understand your suggestion to check with PDO/OBP. Can you be more specific? If you are suggesting that I forward this request to another office, can you please specify which office that would be? If it is inside CPB, shouldn't this request be moved there internally? Thank you for your time.
Sincerely,

I am writing to appeal the decision to close this request due to the Office of Commissioner not having the information I've requested. As stated in my request, page 10 of the "May 2014 through December 2015 Sexual abuse and Assault in Holding Facilities Report" states that:
"CBP has improved the CBP public complaint system that serves as an alternative method for individuals in CBP custody to report detention related concerns, including allegations of sexual abuse and assault, directly to CBP. The CBP Info Center administers the program and has dedicated Spanish speaking personnel to process the complaints and route appropriately."
Furthermore, the CBP website (https://www.cbp.gov/travel/customer-service/handle-complaints) indicates that "The INFO Center tracks and records complaint or compliment information in an automated tracking system to ensure a proper review of all issues raised by the complainant." And this article refers to a FOIA request which shows the complaints received by the CBP INFO Center: http://securitydebrief.com/2015/10/21/foia-request-delivers-new-cbp-data-on-customer-complaints-compliments/
Please direct this and my original request to CBP's Privacy and Diversity Office, or the office that oversees the INFO Center.

CBP-OC-2018-018173 Dear Silvia Vinas
The U.S. Customs and Border Protection (CBP) Freedom of Information Act (FOIA) Division received your letter inquiring about a FOIA request that you previously submitted to CBP reference FOIA number CBP-OC-2018-018173.
This letter is to confirm that your FOIA request has been received by CBP and will be processed in the order it was received. Once responsive records are available, you will be notified electronically by CBP FOIA that records are available to view via your FOIAonline account. If you already have a FOIAonline account, you can view or print responsive records from your account. If you do not already have a FOIAonline account, please create one by taking the following steps:
* Simply go to your search engine (i.e., google, etc.) and type FOIAonline, then hit enter, that will take you to the FOIAonline site.
* From there, press the button on the right “Create Account” and follow the prompts to create a FOIAonline account.
Submitting a FOIA request online is the preferred method (vs. postal mail) for many reasons:
* You immediately receive a unique FOIA tracking number and acknowledgment that your FOIA request was received by CBP.
* You can track your FOIA request any day/any time through your FOIAonline account.
* When responsive records become available, you receive an email letting you know records can be viewed via your FOIAonline account,
* You can view all of your historical FOIA requests via the “dashboard” in your FOIAonline account.
In the future, please use your FOIAonline account to submit future FOIA requests to CBP. Please note that all FOIA requests for official travel records on an individual must include 1) the subject’s name, 2) the subject’s date of birth, and 3) third party consent. If this information is not provided with the original FOIA request, it will be considered “insufficient”, and will not be processed.
Finally, the CBP FOIA office has a significant backlog of FOIA requests. The expected response time for a FOIA request for travel documents is 3-6 months. If you do not receive a response to your FOIA request within 20 business days, please do not resubmit the same FOIA request as it creates further delays. We are working very hard to clear the FOIA backlog and we thank you in advance for your cooperation.

CBP-2018-091013
Dear Silvia Vinas,
After careful review of your FOIA request, CBP-2018-091013, we have determined that your request is too broad in scope or did not specifically identify the records which you are seeking. FOIA is not a search mechanism. Records must be described in reasonably sufficient detail to enable government employees who are familiar with the subject area to locate records without placing an unreasonable burden upon the agency. For this reason, §5.3(b) of the DHS regulations, 6 C.F.R. Part 5, require that you describe the records you are seeking with as much information as possible to ensure that our search can locate them with a reasonable amount of effort.
The FOIA does not require an agency to create new records, answer questions posed by requesters, or attempt to interpret a request that does not identify specific records.
This is not a denial of your request for records. Please resubmit your FOIA request, along with a more detailed description of the records being sought, by logging into your existing FOIAOnline account or creating an account at https://foiaonline.gov. (https://foiaonline.regulations.gov/)
Sincerely,
U.S. Customs and Border Protection
