This is a request under the Freedom of Information Act. I hereby request the following records:
CONPLAN 3502: Civil Disturbance Operations
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Fees cannot be waived for the subject FOIA request. To process your FOIA
request you must meet the criteria as stated in DoD 5400.7-R, para C1.4.2.
The following item needs to be properly addressed:
You must state the willingness to pay fees associated with the processing of
your request. We have three fee categories:
1. Commercial Use (C): Requesters should indicate a willingness to pay all
search, review, and duplication costs when the records are requested for
commercial use
2. Educational / News Media (EM): Requesters should indicate a willingness
to pay duplication charges in excess of 100 pages if more than 100 pages of
records are desired
3. All Others (O): Requesters who do not fit into any of the previous two
categories should indicate a willingness to pay assessable search and
duplication costs if more than 2 hours of search effort or 100 pages of
records are required.
Subsequent processing will be assessed at the established DoD fee rates of:
clerical search time--$20 per hour; professional search time--$44 per hour;
executive search time--$75 per hour, and document reproduction at $0.15 per
page.
We find your fee category to fall under "All others." Please provide an
estimate of what you are willing to pay. Upon receipt we will process your
request.
Until this FOIA office receives a perfected FOIA request we will not be able
to process your request.

Regarding the subject FOIA request with assigned FOIA case number:
FY12-21SEP2012-NNC65; we do not require additional clarification.
Per our interim response sent 15 Oct 12, the CONPLAN 3502 was sent to another
Department of Defense (DOD) agency for consultation for release
recommendation. The DOD agency has not provided an estimation of when their
release recommendation will be made.
I apologize I cannot give a better estimation of when a response will be sent
at this time.

Per our interim response sent 15 Oct 12, the CONPLAN 3502 was sent to another
Department of Defense (DOD) agency for consultation for release
recommendation. The DOD agency provided a response to USNORTHCOM on 10 Jan
13. You should be receiving our final response by 18 Jan 13.
