Rules of Professional Conduct: Rule 8.3--Reporting Professional Misconduct
(a) A lawyer who knows that another lawyer has committed a violation of the Rules of Professional Conduct that raises a substantial question as to that lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects, shall inform the appropriate professional authority.
(b) A lawyer who knows that a judge has committed a violation of applicable rules of judicial conduct that raises a substantial question as to the judge’s fitness for office shall inform the appropriate authority.
(c) This rule does not require disclosure of information otherwise protected by Rule 1.6 or other law.
Rules of Professional Conduct: Rule 4.1--Truthfulness in Statements to Others
In the course of representing a client, a lawyer shall not knowingly:
(a) Make a false statement of material fact or law to a third person; or
(b) Fail to disclose a material fact to a third person when disclosure is necessary to avoid assisting a criminal or fraudulent act by a client, unless disclosure is prohibited by Rule 1.6.
The requested documents will be made available to the general public, and this request is being made for commercial purposes.

Stone appeals this decision "that no responsive records were found" for these reasons and others.
This appeal is being filed as a place holder for Stone and to preserve his right to FOIA litigation in the future.
This appeal is also to prevent the DOJ/FBI from claiming in the future some type of impunity/immunity from compliance with the "Rules of Professional Conduct".
Stone's personal experience over the past 25 years of dealing with the DOJ/FBI in matters pertaining directly and/or indirectly to Gilbert Sapperstein, Charles Richard Longo Sr. , their known associates, and/or entities is that the DOJ/FBI can not be trusted under any circumstances, specifically the DOJ/FBI lawyers.
And that the DOJ/FBI suffer from alleged institutionalized corruption based on my personal experience and opinion.
Stone's most recent FOIA experience with the FBI/DOJ simply serves to confirm his past experience based on a small sampling of his numerous FOIA requests where the DOJ or FBI claim certain files are missing, 302 reports are missing, files that mention Donald Stone are missing, a 302 report of a personal interview Stone had requested and been granted by FBI headquarters which was conducted by a female FBI agent in West Palm Beach, FL. on or about April 2001 is missing, files emailed by Stone directly to the FBI RIDS Div. in Virginia appear to be missing, ad nauseam
Allegations of DOJ/FBI misconduct place a heavy burden on FOIA requesters, mere allegations are not sufficient.
Stone has easily met and exceeded that burden with irrefutable documentary evidence in the federal court record in 1998, Stone vs. Warfield Sr. (Southern District of FL.) . Six MD./FL. DOJ lawyers were caught lying trying to white wash the alleged multiple federal felony offenses of Longo as a business dispute. A textbook case of "Fraud on the Court" by six DOJ lawyers, while their alleged co-defendant co-conspirator Gilbert Sapperstein is busy stealing an estimated $3.5 million from Baltimore School Board early 1990's to 2003.
At first blush it would appear that the corrupt DOJ lawyers were trying to protect Longo, it's alleged that the DOJ lawyers were really trying to protect Longo's associate, Gilbert Sapperstein who had alleged direct or indirect ties to the U.S. Attorney for Maryland, Lynne Battaglia and or her former boss and political crony/mentor Maryland Attorney General, Joseph Curran Jr.
These "Rules of Professional Conduct" are designed to hold lawyers in both government and the private sector accountable for their alleged misconduct even though the reality is that "Self policing equals self protection".
Also there are the allegations of DOJ/FBI misconduct pertaining to:
1. Fraud on the Court (federal and state)
2. Fraudulent concealment of exculpatory documents by DOJ/FBI from victims of white collar criminals and/or organized crime.
3. Fraud in the omission.
And incorporate by reference:
All DOJ/FBI files pertaining to Gilbert Sapperstein, Charles R. Longo, associates , and entities.
All DOJ/FBI files pertaining to any criminal and/or civil complaints filed against Gilbert Sapperstein, Charles R. Longo, associates , and entities from Maryland, Florida, New York, Virginia, D.C. or Delaware.
For these reasons and others appeals this matter.
