This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of emails and other communications between the Federal Housing Finance Agency and representatives of the City of Richmond, Fannie Mac, Freddie Mac and/or Mortgage Resolution Partners regarding the use of eminent domain on mortgage loans or the cessation of FHFA-backed lending in Richmond, CA.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I would like to amend my request to include copies of any legal opinions created by or for the FHFA regarding the use of eminent domain or the legality of cessation of lending as it pertains to this case.

Dear  Morisy: This confirms receipt of your Freedom of Information Act (FOIA) request, dated August 9, 2013.  Your request was received in the Federal Housing Finance Agency (FHFA) FOIA office on August 9, 2013, and assigned
the FHFA FOIA request number 2013-FOIA-101.  Please refer to this number in any correspondence concerning your request. You requested the following information: "A copy of emails and other communications between the Federal Housing Finance Agency and representatives of the City of Richmond, Fannie Mac, Freddie Mac and/or Mortgage Resolution Partners regarding the use of
eminent domain on mortgage loans or the cessation of FHFA-backed lending in Richmond, CA."
You also requested a fee waiver.  Based on our review of the information you provided in your request, FHFA has determined that your response does not adequately meet the statutory standard for granting a fee waiver, as set forth in the FOIA, 5 U.S.C. 552(a)(4)(A)(iii),
and FHFA’s FOIA regulation, 5 CFR 1202.11(h). Therefore, your request for a waiver of fees is denied.
Please note that pursuant to the FOIA and FHFA regulation, 12 CFR Part 1202.11(b), you have been categorized as a “representative of the news media” requester and will be charged for duplication cost
in excess of 100 pages. Please note that fees are not automatically waived for representatives of the news. Please see our FOIA regulations at 12 C.F.R. § 1202.11 for more information about fees and fee waivers.
Additionally, FHFA processes requests under a multi-track system (standard, and complex). After review of your request, it has been determined that your request will be placed in the standard track. FOIA requests are placed in this track based on the volume
and/or simplicity of the records requested.
Your FOIA request is releasable to the public under subsequent FOIA requests. In responding to these requests, FHFA does not release personal information, such as home or email addresses and home or mobile telephone numbers, all of which are protected from
disclosure under FOIA Exemption 6 (5 U.S.C. § 552(b)(6)).
