As a representative of the news media I am only required to pay for the direct cost of duplication after the first 100 pages. Through this request, I am gathering information on entities or individuals that maybe have influenced policy changes. That is of current interest to the public as policy changes from the EPA have broad reaching impacts to the health and wellbeing of the American public and are currently a subject of national news value.
This information is being sought on behalf of ThinkProgress.org (an online news service) for dissemination to the general public and this request is not being made for commercial purposes. I am a reporter with ThinkProgress, an online news site with a national audience seeking these documents entirely for news-gathering purposes.
I would like to receive the information in the following format: electronic.
Please waive any applicable fees. Release of the information is in the public interest because EPA policy changes have broad reaching impacts to the health and wellbeing of the American public and are currently a subject of national news value. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.
If my request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all segregable portions of otherwise exempt material. I sent a FOIA request EPA-HQ-2017-005445 (below) on 3/29/17. In it, I requested expedited processing and a fee waiver, based on the fact that it was a hugely important current national news story and I am a journalist at a national news site. Nearly 5 months later, I have not received the FOIA (which I would appeal as a constructive denial) and indeed have not even received a response to my expedited processing request (which also appears to be a constructive denial).
The timeline:
3/29/17 Filed (via MuckRock, an online service that allows users to track FOIA requests in one place).
Received an autoreply from foia_hq@epa.gov confirming receipt.
4/7/17 Jonathan Newton approved the fee waiver request
5/8/17 Sent request for status update – no response
6/7/17 Sent request for status update – no response
7/7/17 Sent request for status update – no response
8/7/17 Sent request for status update – no response
The online request site, as of 8/11/17 (https://foiaonline.regulations.gov/foia/action/public/view/request?objectId=090004d2812302b7) lists an estimated date of completion as April 26, 2017.

Under certain conditions, you may be entitled to have your request processed on an expedited basis, i.e., within 10 calendar days of the date on which the request was received. However, in an effort to treat all requesters equitably, EPA will expedite a FOIA request only in cases in which there is a threat to someone's life or physical safety; the requestor is primarily engaged in disseminating information and has established that the request is urgently needed to inform the public concerning some actual or alleged government activity.
Given that the EPA’s coal regulations were expressly created to protect against the loss of human life (https://www.federalregister.gov/documents/2015/04/17/2015-00257/hazardous-and-solid-waste-management-system-disposal-of-coal-combustion-residuals-from-electric), the decision to remove these protections could absolutely be deemed to threaten the life and physical safety of the American public.
I am a reporter for ThinkProgress, a national online news site. As I mentioned in my request, I am seeking this information entirely for public dissemination and it is being sought to determine the reasons for EPA’s actual activity in coming to this highly newsworthy and controversial decision. Given the intense lobbying for these regulations by the industries they impacted, release of this information is essential to the public’s understanding of how this decision was made. And since Congress is currently reviewing legislation (https://www.congress.gov/bill/115th-congress/house-bill/3314/text?q=%7B%22search%22%3A%5B%22coal+ash%22%5D%7D&r=1) that could affect these rules, this remains timely and newsworthy.
