Pursuant to the Freedom of Information Act, I hereby request the following records:

Records mentioning or pertaining to the late Dutch businessman Erik van Sabben (31 January 1972 - 16 January 2009) including (but not limited to) any and all records of border crossing, travel, or secondary screening.

Van Sabben was the business development manager of Dubai's TTS International. A recent news report by Volkskrant (https://volkskrant.nl/nieuws-achtergrond/aivd-speelde-cruciale-rol-bij-sabotage-kernprogramma-iran~ba24df9f/) named him as a Dutch intelligence asset.

Van Sabben's death was widely reported (https://www.thenationalnews.com/uae/engineer-who-helped-build-the-maqta-bridge-1.553285). As such, privacy concerns under FOIA Exemptions 6 and 7 are voided, as are any concerns under the Privacy Act.

If any part of these documents are exempt from disclosure, please be sure to review and release all reasonably segregable nonexempt portions of responsive documents, as the FOIA requires.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a final response to your Freedom of Information Act (FOIA) request to U.S. Customs and Border Protection (CBP) for records mentioning or pertaining to the late Dutch businessman Erik van Sabben.

CBP is granting your request under the FOIA, Title 5 U.S.C. § 552. After carefully reviewing the responsive documents, CBP has determined that they are approved for release in their entirety, no deletions or exemptions have been applied.

For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. 552(c). This response is limited to those records that are subject to the requirements of the FOIA.
