This is a request under the Freedom of Information Act. I hereby request the following records:

The most current copy of the FBI reading room index/list of preprocessed files. The list was previously posted to http://foia.fbi.gov/foiaindex.htm with the most recently posted copy (Reading Room Index Compiled as of 01/23/2004) which is now nearly thirteen years old. The list was also previously known as the "FBI FOIPA PREPROCESSED LIST" Please note that I am NOT asking for the list of files posted to the Electronic Reading Room, but rather the complete list of preprocessed files in whatever format it currently exists and is used by the Bureau to determine whether or not the files have already been processed.

I am a member of the news media and request classification as such. I have previously written about the Bureau for AND Magazine, MuckRock and Glomar Disclosure. My articles have been widely read, with some reaching over 100,000 readers. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am appealing this FOIA response on the basis that it is not responsive to my request. My request clearly specified that what they responded with is not what was being sought. "Please note that I am NOT asking for the list of files posted to the Electronic Reading Room, but rather the complete list of preprocessed files in whatever format it currently exists and is used by the Bureau to determine whether or not the files have already been processed."

I am appealing the responsiveness of these records as they are not up to date nor even the most recent copy. Per my original request, the FBI had previously posted a version of the list from 2004. Thus a copy from 2003 is even less up to date, and thus is not responsive to the request for the current or most recent copy. It is not even a good faith attempt to fulfill this request.
