Pursuant to the Freedom of Information Act, I hereby request the following records:

Any and all data, reports, or statistics that track the number and outcome of prosecutions that DOJ has undertaken for illegal take under the Endangered Species Act for the following species: grizzly bears. This request seeks records for all prosecutions conducted since January 2015.

I am a reporter for The Guardian, The Nation and other outlets.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is an appeal under the Freedom of Information Act, 5 U.S.C. §552 in reference to the following FOIA request: EOUSA-2023-002794
EOUSA's final response letter to me is attached below as well as my original request, and the relevant released documents. The agency provided its response to my FOIA request on September 20, 2023. I am writing to appeal its response.

My original request sought records for all prosecutions conducted since January 2015. However, the agency only released records that include prosecutions up to the year 2018. I seek the remaining records of all relevant prosecutions for the illegal take of grizzly bears under the ESA for the remaining years that weren't included in the release: 2019, 2020, 2021, 2022 and 2023.

I trust that upon re-consideration, EOUSA will release the remaining records to me. However, if within twenty days I have not received a full response to my request, I will deem the appeal denied and explore initiating a lawsuit to compel disclosure on one or more of these requests. As I have made this request in the capacity of a journalist and this information is of timely value, I would appreciate the EOUSA expediting the consideration of my appeal in every way possible. In any case, I will expect to receive the department's decision within 20 business days, as required by the statute.
