All (records) documents and emails that were retained and preserved by commander James Mattis in relation to the Haditha-Hamdania incidents (which are clarified below in the marines.mil link). This was ordered by MARADMIN 303/06, which is linked below.

Expedited Processing:

I am requesting expedited processing as James Mattis could end up being the next director of the Department of Defense. The public deserves to know his involvement, processing, and documents that were preserved by him involving an incident that even the marines described as "unclear". The public deserves to know this information before the senates potential confirmation of James Mattis.

This request meets the criteria for expedited processing under 28 CFR 16.5(e)(1)(iv and ii), as “[a] matter of widespread and exceptional media interest in which there exist possible questions about the government’s integrity which affect public confidence.” This is acknowledged by the Marine Corp itself in the link (MARADMIN) above stating, "THE ALLEGED EVENTS AT HADITHA AND HAMDANIA HAVE GENERATED INTENSE INTEREST BOTH IN THE MEDIA AND CONGRESS. "

In relation to 28 CFR 16.5(e)(1)(ii) the potential information would be disseminated via twitter, and all documents publicly available on Muckrock.com, the news organization Elevnth, and potentially on the platform medium.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have received your FOIA request seeking records preserved by General James Mattis in relation to the Haditha-Harndania incidents and have assigned the above cited case number to your request. We initiated a search for responsive records on January 3, 2017 and hope to have a response to you soon. We also partially referred your request to the 1st Marine Division (IMARDIV) under case # DON-USMC-2017-002272 for action and direct response to you. The POC at IMARDIV is Capt Vic Sanceda at 760-725-3622.

In addition to your FOIA request, you also requested expedited processing. After careful review, the basis you provided did not demonstrate the kind of compelling need required for us to place your request ahead of all the others that are pending. We must, therefore, deny your request.

You may consider this to be an adverse determination that may be appealed to the Judge Advocate General (Code 14), 1322 Patterson Avenue SE, Suite 3000, Washington Navy Yard, DC 20374-5066. Your appeal, if any, must be postmarked within 90 calendar days from the date of this letter and should include a copy of your initial request, a copy of this letter, and a statement indicating why you believe it should be granted. We recommend that your appeal and its envelope both bear the notation "Freedom of Information Act Appeal."
