This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of the initial petition and the defendant's first answer in TTAB case 92021069. On this site, http://ttabvue.uspto.gov/ttabvue/v?pno=92021069&pty=CAN, the documents in question are numbers 1 and 5.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

The information I seek in my FOIA request is not made publicly available online. While an index exists, the petition and initial answer are not electronically accessible from the link that I referenced above, though other documents from the case are available. This could be because these initial filings were made in 09/1992 and 12/1992.

According to 37 CFR 2.27(c), proceedings related to TTAB cases are available for public inspection. However, 37 CFR 102.2(b) only requires the FOIA Officer to make public electronically records created on or after November 1, 1996, in accordance with 5 USC (a)(2)(E). Because the records I seek in my request are for copies of records created in 1992, they are therefore unavailable online. Additionally, if one goes to the online ordering site to obtain copies of records (which seems to be geared for certified copies, which are unnecessary in my case), it notes the ability to obtain free electronic copies as they are publicly available online; however, the records at question in my FOIA request are, once again, not available online.

Please advise me on how to proceed to obtain the records I seek, if you continue to deem them outside the scope of FOIA.
