This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all contracts for the development, maintenance, design, optimization, or other work concerning the healthcare.gov website. You may limit the results to those where the contracts required work to be done in or completed in the calendar years 2013 or 2014.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Smathers:

This is an interim response to your Freedom of Information Act (FOIA) (5 U.S.C. § 552) request of October 19, 2013 for a copy of all contracts for the development, maintenance, design, optimization, or other work concerning the healthcare.gov website for the work that was done in or completed in the calendar years 2013 or 2014.

The documentation enclosed with this interim response is specific to the contracts for the development, maintenance, design, optimization, or other work concerning the healthcare.gov website for the work that was done in or completed in the calendar years 2013 or 2014, specifically, CGI Federal, Inc. A search performed by our agency located 351 pages of documentation responsive to your request. After careful review of the documents submitted to me, I have determined to release 329 pages to you, in their entirety and deny you access to portions of 24 of the released pages pursuant to Exemptions 4 of the FOIA (5 U.S.C. § 552(b)(4)).

Exemption 4 protects information which constitutes "trade secrets and commercial or financial information obtained from a person [that is] privileged or confidential." This exemption is intended to protect the interest of both the government and submitters of information. Moreover, Exemption 4 affords protection to those submitters who are required to furnish commercial or financial information to the government by safeguarding them from the competitive disadvantages that could result from disclosure.

The portions of pages withheld under this exemption constitute the names of key personnel and non-managerial staff. Release of information concerning the submitter's personnel might allow a competitor to raid the submitter's personnel and hire away key employees. This could enhance the competitor's position and might hurt the submitter's position, especially where the quality of technical or management personnel is important in performing the work.

If you disagree with the decision to withhold portions of the documents determined to be exempt from disclosure, you may appeal. However, should you elect to file an administrative appeal, I ask that you submit any such appeal after receiving my final response to your request. That response will advise you of our agency's procedures to formally submit an administrative appeal which can be submitted within 30 days of our final response to your FOIA request.
